Musa, has declared that in Kosovo, the strike is guaranteed by law. According to him, power in Kosovo wants to replace “insistent”, the demands of public sector workers.
“It is a criminal offence to abuse authorisation, because the strike is guaranteed by law, the only obligation of trade unions has been to warn the 7-day strike, while the decision warned is a scandalous decision, is contrary to Article 11 paragraph 2 of the strike law, since this provision that the employee cannot be discriminated against”, Musa said.
Lawyer Musa has said that for such a decision to be made by the Ministry of Finance, then the strike must be illegal. According to Musa, the courts, not the Ministry of Finance, confirm this.
“It is discrimination if such decisions are made, the law speaks of legal and illegal strikes, should address the courts to see whether legal strikes are or not. Based on international conventions, it ensures the right of workers to strike, even on dictatorial systems, strikes in Kosovo, have been warned at times”, it has indicated.
On the other hand, Musa has made it known that if the decision is made to deprive the strike of wages, there is enough basis for the state to be indicted.
“has immediate grounds to sue the state. I don't think this decision will be made, it's important that it's known that it was read only the provision Article 1 on 18 while paragraph 2 and three did not read it at all”, he stated.
The lawyer, Musa, has stressed that social dialogue between unions and the Government of Kosovo is necessary.
