At the conference on the progress of the case against former KLA leaders, lawyers have criticised the Prosecutor's Office specialised for the delay in handing over extenuating materials.
According to the defense, the prosecution owns such documents but does not reveal them.
In this regard, Judge Guillou has told the prosecution that the same should produce excusing materials if he owns them, stressing that the defence has the right to obtain such documents.
“The material that you have but can be made culpable because there may be a new reasoning or there may be new information, or there may be things that might be considered excusing, can be blamed, and at the time of the initial analysis you haven't thought of these materials as excusing but now come out excusing, what I understand now is what should be considered a defamatory now, so I don't understand why such a controlled ethics cannot be realized. If it's clear that we're dealing with excusing materials now, it has to be extracted, so, period. So the way you do the process is your job, defense has nothing to do with this, but protection has to take what's right to get, so I have to take the excusing material”, the judge of the preliminary procedure said.
The conference on the performance of the issue by Hashim Thaci, Jakup Krasniqi, Kadri Veselini and Rexhep Selimi is continuing with discussions between the parties. While the accused are participating in the video connection.
The act towards Thaci and others regarding war crimes claims has been confirmed on October 26, 2020, while in their first presentations at Specialised Chambers in The Hague they have been declared innocent.
They are staying in custody at The Hague since November 2020.
On April 29th, the Specialised Prosecutor's Office has handed over a amended indictment against Hashim Thaci, Kadri Veselin, Rexhepi and Jakup Krasniqi, where it claims the accused committed war crimes in Gjilan, Budakov and Semetish.
