AIP through a communiqué has estimated that it is legal violation if lists with personal data are made public “that identify the subject of data at this stage, without having a final decision of justice organs”.
The AIP said that the relevant “institutions which have processed this data must take the necessary legal measures not to breach individual personal data”.
Moreover, the KLA Veterans' Organisation has the right to process personal data of its members for clear and legitimate purposes by adhering to the principles of data processing, by taking all necessary organisational measures for their preservation and safety, and by not allowing unauthorized access to other persons”, it is said in communique.
Full communication:
The Agency for Information and Privateity called on all institutions, written and electronic media and citizens not to publish lists with the personal data of the Kosovo Liberation Army veterans until the final decision issued by the law bodies.
The agency, the Agency for Information and Privateness, as the sole mandated authority with Law No.06/082 for the Protection of Personal Data for Supervising the legality of personal data processing, finds that publishing lists containing personal data identifying the subject of data at this stage, without having a final decision of justice organs, constitutes violation of the Law on the Protection of Personal Data.
In this case, relevant institutions that have processed this data must take the necessary legal measures not to violate individuals' personal data. Processing should be done by respecting the principles and measures that have defined relevant legislation regulating the veterans' issue and relevant legislation on personal data protection.
Moreover, the KLA Veterans' Organisation has the right to process the personal data of its members for clear and legitimate purposes by upholding the principles of data processing, by taking all necessary organisational measures for their preservation and safety, and by not allowing the unauthorized approach of other persons.
The competent law-designed institutions, which are handling the veterans' case, should only process this data for specific purposes, ensuring the necessary measures of their protection and adhering to legitimate principles of personal data protection until the final decision of the justice organs is made.
The Information and Private Agency will consistently ensure the supervision of the personal data protection law. For any violation of the provisions of this law, the Agency will take the first sanctions measures, respectively, it will pronounce fines for violators of this Law.
