O The EMS doesn't show how much money it's holding up to companies from 799 complaints made.

Over a year, Procuring Organisation (OSHP) was without functional board, and this led to a large number of complaints by economic operators for tenders, in addition to these complaints these operators are obliged to deposit a certain amount of financial means depending on the amount of tender, which is regulated by law. But how much is O The EPS has collected from these complaints that the latter has been reluctant to respond, placing the responsibility at another institution.

O The timer in an answer for Metro Journal, has said that the number of complaints raised and passed the legal deadline for review is 799.

While many means have been blocked by economic operators by complaints have not become clear, O The EMS have dismissed the responsibility by saying to address the State Treasury institution, even though the law clearly states that financial means go to O's account - It's time.

The State Treasury has not come up with any clarification on this.

By Public Procure Law, Article 118, decitically said that “payment will be made in cash or at the equivalent of cash available in an open account from O The spread in accordance with Financial Rules”.

Save By Adjust drawn up by the Public Procuration Regulatory Commission (KRPP), Article 14.2 says:

“14.2 In accordance with Article 118 of the LPP, all complainers should pay a fee of complaints on O The E.P.

a. Whenever the complaint is linked to the decision to reward a contract, the amount of the complaint fee is equal to one percent (1%) of the bidding value, but no less than 100 euros and no more than 5,000 euros.

b. Whenever the complaint is related to contract reporting, the tender documents, the amount of the complaint fee is equal to one percent (1%) of the projected value, but no less than 100 euros and no more than 5,000 Euro”.

And it goes on to stress that payment from economic operators will be made with cash available or equal in the account created by O The E.P.

So, the Procureing Organization (OSHP) has accounts where economic operators deposit certain amounts of tools, depending on the value of the tender, in case they decide to file complaints.

Hundreds of complaints already under way in O The EPS, but what is the total amount deposited by complainers in this body, remains unknown.

We remember that since March 31, 2021, this institution had been without a functioning board, as a result of some 800 complaints with 550 procurement activities.

The value of the tenders blocked in this period is estimated to be around 300m euros.

The Kosovo Assembly, on June 23rd this year, has elected the chairman and four members of the Procureing Organisation Board.
