Dardan Mollishaj is missing from session, arrest warrant issued again

Because Dardan Molyqaj, president of the Social Democrat Party (PSD), has missed Friday's session, has again failed to start judgment on the case of physical clashes between him, his companion and VV deputy Hakki Abazi, following a televised debate in 2019. So Moliq, the court has issued warrants.

Fatos Sahiti, who was present in the courtroom, is also charged, reports the “Bet on Justice”.

Regarding the absence of indictee Molyqaj, case judge Vlora Pacolli-Rexhepi suggested the same was arrested on the basis of the arrest warrant issued by the tribunal on 17 June of this year.

Judge Pacolli Rejepi said his arrest was made after the court's work hours and said there were no conditions for holding the session.

The reason for the arrest warrant, according to Judge Pacolli-Rejepi, has been the incorrect address accused Moliqaj had left on the subject's paperwork.

On the other hand, the same stated that the court in co-ordination with accused Moliqaj and after his promise that the same will be presented at the next session has revoted the warrant.

Then the court in co-ordination with defendant Dardan Molyqaj and after his promise that the same will be presented at the next session and after the same has secured the exact address and accepted the invitation by warning and announcements of legal consequences for not appearing court, to the same date as 17.06.2022 has revoted the arrest order on the 01.06.202218x1>, Judge Pacoli-Rege said.

However, because the same one after accepting the invitation, revocation of the warrant and after the same promise had been made to the session, Judge Pacolli-Rexip said that for the same conform article 307 and 175 of the Penal Procedure Code the court again issues a new warrant on Moliq.

Since the accused Sahiti was in the hearing, the prosecutor of the Pacolli-Rejep case has informed him of the reasons the court has issued an arrest warrant against him, because according to her in the brochure of April 29, 2022, it has been concluded that the accused refuses accepting the invitation.

In this regard, the accused Sahiti stated that no one has ever been contacted and that the consisting of that turning sheet is incorrect.

He said he has been contacted yesterday by Kosovo Police to accept the tribunal's invitation.

I never accepted an invitation to the session, and I have received an invitation from the court or anyone who has been committed to bringing in the invitation”, accused Sahiti said.

For this, Judge Pacolli-Rexhepi said the court would verify the delivery sheet which was implemented by the post office, and announced the same about the consequences of failing to appear in court.

At this session, Hakki Abazi was not even on hand, for which his representative, Sadije Medici, said the same again is found abroad on an official trip.

Since conditions for holding this session were not met, the same has been postponed indefinitely.

And all in the end, Judge Pacolli-Rejepi stated that according to her, under the procedure of how it's flowing so far, conditions have been met for appointing Molyqaj's detention, but the same must first be arrested, brought to court and then the detention is appointed.

Otherwise, according to the indictment filed on February 18th 2020 by Pristina Constitutional Prosecutor Dardan Moliqaj and Fatos Sahiti are charged with committing criminal work “in co-ordination. Attack”, from Article 184 paragraph 1 concerning Article 31 of the Republic of Kosovo Criminal Code, the act punishable by fine or imprisonment to (1) year.

The indictment reportedly appears on September 11, 2019, about 22:00 in Fushe Kosovo, at the “College. AAB”

On the other hand, the indictment is said to have approached the defendant Molyqaj on purpose, using force to attack the injured Hakki Abazi in a way that he originally captured for his hands and then punched him in the face and kicked in the leg.

All in accordance with the indictment, the defendant Sahiti's attack on the victim, who strikes the victim with his fist until the injured manages to escape and quickly flee into T7 television studio, and thus worried about the case, calls the police.
