Netherlands with bad news for the accused's parents in The Hague, visa procedures relax

The Dutch Ministry of Foreign Affairs has decided that from 1 July, 2022, it will not facilitate visa issuing procedures for the parents of the accused in The Hague.

The Netherlands MPJ has unveiled this position to Kosovo's Specialised Chambers through an official letter on 22 March this year. The Dutch government has demanded that the same letter be forwarded to the Kosovo Embassy in Amsterdam.

According to the Netherlands Ministry of Foreign Affairs' position, easing the procedures for the parents of the accused and detainees' visas at The Hague is not in line with the Prissa State Agreement, linked between Kosovo and Dutch governments in 2016.

The ministry is prepared to apply a transitional period for the Specialised Chambers until July 1, 2022, during which the host state will facilitate parents' visas, though this is not in line with the permanent policy for Courts and Tribunals”, the Dutch MPJ official letter provided by Paparaci says.

The issue has been raised in the Dutch State and Specialised Chambers corruptions following the court's request for easing the visa for one of the pre-prisoned parents in The Hague in March this year.

The ministry confirms that the above-mentioned case has been communicated by Kosovo's Specialised Chambers in March 2022, when the host state was asked to provide assistance to provide visas for three family members for a family visit to one of the detained in the detention unit of Specialised Chambers at The Hague”, the Dutch government states.

But, the request of the Specialised Chambers has been rejected by the Dutch state, based on the Waiting State Agreement.

“was later noted that visa application concerned the father of the detainee”, reportedly in the letter. “This prompted the host state's decision not to facilitate a visa for the father in line with politics (laws) in the country”.

The Dutch ministry says the decision to reject visa relief for one of the pre-prisoned parents in The Hague has been communicated to the Special Chambers on 10 March and 15 March 2022.

The letter highlights violating the agreement in a case in 2021, when the Dutch state had allowed a parent's visit of war crimes indictees from the Special Chambers.

According to the Dutch MPJ, the case was a miscommunication among institutions.

On June 4th, 2021 Specialised Chambers were not properly informed by the host state with e-mail. Moreover, the host state, for unknown reasons, wrongly facilitated the visa for the father of the convicted in question in September 2021, said the Dutch state's letter of residence.
