The Constitutional Court of the Republic of Kosovo has found that the Ministry of Science and Technology, led by Minister Arberie Nagavci, violated the Constitution of Kosovo with the decision of April 23rd 2021, which gave the directive for organising teaching in the Kamenica municipality and dismissed reform undertaken by Kastrati.
The court has assessed the constitutionality of the April 23rd 2021 decision of the Ministry of Education, Science, Technology and Innovation (in the next text): SERVANT). The request for assessing the constitutionality of this act has been submitted to the Court by the Kamenica Community based on authorisations defined with Article 113's paragraph 4 [Jurisdiction and Authorised Pals] of the Constitution of the Republic of Kosovo. In assessing the constitutionality of the controversial decision, the Court unanimously ruled that (i) the request is acceptable; (i) the verdict [in]. April 23, 2021 of August, is not compatible with Article 2 paragraph 12 [Local State], paragraphs 1 and 3 of Article 123 [General Principles] and paragraphs 2 and 3 of Article 124 [The Organisation and Function of Local Self-Government] of the Constitution; (ii) reject the requirement for temporary measure; and (iv) reject the demand for withdrawal of”, the Constitutional decision says.
