Notaries win: Court Breaks Down Minister Haxhiu's Decision to Cancel Competition

The Foundation Court in Pristina, the Department for Administrative Affairs, has cancelled the Justice Ministry's decision, with which the competition for swimming had been cancelled. This has since the indictment of 44 candidates for notaries exercised to this MD decision has been approved.

The decision, secured by the signal, is said to have confirmed the process of testing Noteria, declared on April 19, 2019, as legal and fair.

The court has made this decision with the reasoning that it has found no evidence that the indictee, either in administrative procedure or even before the court, has proved that the Commission for Providence for Noteria has violated the principle of legitimacy.

This is about the fact that no evidence has proved that this commission has exceeded the limits defined by the law, it has not been confirmed that with the election of this commission, no purpose has been achieved by law and in accordance with the principle of proportionality and that its choice has not been proven to have been contrary to the entire accepted norms of science or technique and has not violated fundamental principles of human justice or reason.

We recall that Justice Ministry Minister Albulen Haxhiu had decided in February 2020 to cancel the Noteria exam, arguing that the process of selecting swimmers from past government had not had legitimacy, transparency of the objective, as according to her, most selected candidates have been family and party militants.
