State waste 300 thousand euros on illegal public sector dismissals

In the report released by the FOL Movement, dismissals in the public sector reportedly cost the state over 300 thousand euros.

The report's main goal, therefore, is to attract the attention of institutions responsible for the impact and consequences on the state budget in the case of the disruption of labour relations of employees in the public sector, when the same are done by not respecting the provisions of legislation in force.

Albana Hasani, from the FOL Movement, said that in the Independent Council of Overseers during 2019 and the January 2021 period, 128 complaints have been filed by civil servants over decisions to disrupt the working relations of state institutions. 69 of these complaints had been filed with central administration decisions (exactly 54 %), while the rest of the 54 complaints (or 46 % ) on rulings
Local administration.

The Council's “decisions should be stressed that from January 21st, 2019 to October 2020, the Independent Council for the Civil Service of Kosovo has been dysfunctional, so during this period it has not been possible to make any decisions concerning the earlier requirements. The failure of the Independent Council of Overseers for nearly two years has caused difficulties in protecting the rights of Kosovo civil servants, due to the inability to make decisions on one side, and the collection of large numbers of substances, on the other hand”, Hasani said.

According to Hasan, between October 2020 and October 2021, the Council has ruled on 40 complaints of interruption of the labour relationship, of which 11 have been approved, 3 have been rejected, 22 turned down, 3 have been declared competent, and 1 has returned to review.

Hasani has stressed that during the January period of October 2021, 178 decisions on work disputes have been brought by the Courts of the Republic of Kosovo in cases where the party was represented by state lawyers. Of all these conflicts, 109 conflicts have been lost by state institutions, 44 disputes have been won, 9 have been approved in part, 5 have been turned into retrial, 3 in restoration and, in 1 case, the indictment has been filed due to non-indibility.
