The rule by law for foreign war participants has been spoken of by lawyer Asdren Hoxha by written prononym.
The participation of Kosovo's citizens in foreign war abroad, under the 05 L-002 Law, organisation and leadership are punishable by 5-15 years in prison. Meanwhile, simple turnout is condemned by 3-15 years in prison”, he has declared news.net.
Hoxha referred to Law No. 05,L-002, exactly Article 3 points 1 and 3, entered into force in 2015 for the first time, during the period of former President Atifete Jahjaga's term.
As Article 1 defines Article 3, “Whoever organises, recruits, guides or trains persons or groups of persons with the intention of joining or participating in the military or foreign police, in the foreign paramilitary or pre-police formations, in group organisations or individually in any form of armed conflicts outside the territory of the Republic of Kosovo, is sentenced to imprisonment of five to 15) to 15.15x1>
Meanwhile, the three-point same under the Law for Banning the Union in Armed Conflicts Outside the Country Territory points out that “Whoever participates in the military or foreign police, in external paramilitary or pre-police formations, in group organisation or individually, in any form of armed conflicts outside the territory of the Republic of Kosovo, is sentenced to jail time of three (3) to fifteen years (15) (15x1>.
The same article, point four, also encourages participation in foreign wars, even through social networks.
“Whoever in public, at a collection or by writing, audiovisual filming, including and not being restricted to social networks or any other form of communication, calls or encourages others to commit criminal acts defined in paragraphs 1, 2 and 3 of this article, is sentenced to prison terms of six months (6) to five (5) times” at this point.
The Ukraine-Russia conflict has become a hot spot, and international diplomats are warning of escalation of the situation in the Ukrainian state. In areas such as Donbas, Russian separatists have begun promoting propaganda by means of explosions of military vehicles and gas vehicles. US diplomatic representatives have seen this as “the pretext” for war explosion.
Some Kosovars, referring to the Ukrainian ambassador's statements in Albania, have expressed interest in becoming part of the war there.
“We are aware of the support expressed by Kosovo officials. In addition, citizens of Kosovo, with proposals and questions about how they go to Ukraine to participate in the protection of Ukraine. All these proposals and calls on our ministry. Ukraine is still in the phase of studying the issue of Kosovo's recognition”, has declared Volodyyr Shukurov, Ukraine's ambassador to Albania, for Euronews Albania.
In addition to claims by participants from Kosovo in the Ukrainian war, there has been no official position by Kosovo institutions. However, Presidency cabinet chief Blerim Vela has denied statements by Russia's Foreign Affairs Minister Sergei Lavrov, who claimed that Kosovo and the countries of the region are recruiting militants for Ukraine.
“The false indictment of Russia's Foreign Affairs Minister Lavrov, that #Kosovo is sending mercenaries to Donbass, is an integral part of the deinformative campaign seeking to justify military aggression against #Ukraine. Kosovo supports its allies and Ukraine in protecting freedom and democracy”, it was said in a post of his own in Twitter.
Representatives of all countries in the region have denied it, some have even mocked Lavrov's claims.
Albania's former diplomat, Pandeli Majko, has sought responsibility from the Russian Embassy there over these statements.
“We will launch official investigation at the Russian Embassy in Sarajevo for this statement. If Lavrov has some information on such activities in Bosnia, I hope that, before he finds out, he will share them with our security services“, Bisera Turkovic, Bosnian Foreign Minister, ironically stated on the other side.
