INDEP considers that ZRRE should clearly clarify the form of how consumers will be taxed for energy spent during the month of February. Based on the new tariff decision, KESCO should have started calculating bills for energy spent from the date of late-month taxing January 2022 to February 8th 2022 under old tariffs. Then, KESCO would have to taris consumers for energy spent the last three weeks of February 2022 with new approved tariffs. The ZERE Law, Article 49, gives the ZERE the legal competencies needed to operate for energy management by companies licensed to consumers.

The immediate ZERR intervention is extremely necessary in order to ensure that the regulations in the country are being implemented. Remember Z RRE, which is under obligation to ensure implementation of consumer information standards and to ensure quality service under Article 20 of Law No. 06/L-034 for Protection of its Consumer and Rule Z No. 17/2019 for Electricity Service Quality Standards. These two legal acts, but also articles 53 and 55 of the Law No. 05L-085 for Electric Energy guaranteeing protection of consumer rights in the case of measuring and billing spent energy.
