The Constitutional Court has decided to abolish Albania's decision to dismiss President Ill Meta.
“VANDOS:
Debilitating Decision No. 55/2021, date 09.06.2021 of Albania's Parliament “for the dismissal of the president of the Republic of Albania for serious violations of the Constitution”, It says JSK's announcement.
Constitutional Court Notification:
The Constitutional Court of the Republic of Albania considered the 2002,222 and 07,02,2022 public plenary sessions of dates. 55/2021, the 09.06.2021 Albanian Parliament “for the dismissal of the president of the Republic of Albania for serious violations of the Constitution”.
At the conclusion of the investigation of the matter, the Constitutional Court estimated that:
It has jurisdiction for examining this issue, in line with the predictions of Article 90 and 131, provisions 1. “dh” of the Constitution and within the limits of its review enter both the verification of procedures followed by the Parliament and the definition of serious wrongdoing, as well as the provability of relevant facts.
The Assembly has the legitimacy to be party to this process. The Parliament's X legislature, based on the principle of institutional continuity, has legitimacy to represent its IX legislature.
Likewise, the IX Parliament's Legisstance has had substantial legitimacy, in the assessment of the moment of the constitution, the replacement of MPs, the total number of MPs, the lack of competent organ decisions to declare irregularities or inadequacy of the replacement of mandates, and the possibility of this legislation reaching the necessary quotas, as well as the whole of passed laws and decisions.
The Constitutional Court, after verifying the procedure followed by the Parliament for the establishment of the investigative commission, ensures the president's right to be heard and protected and keeping the Constitutional independence of the Parliament in mind, generally found there were no constitutional violations during this procedure.
Regarding the causes for which the Parliament has established the president's dismissal, the Constitutional Court, after defining the objective elements of the “serious constitution” envisioned in Article 90, provisions 2, of the Constitution, and praising the application of Article 90, provisions 3 of the Constitution to prove the president's guilt, concluded that:
1. The facts presented as violations of Article 86, point 1, and Article 89 of the Constitution are not serious violations of the Constitution.
2. There is no serious violation of Article 88, Article 3, of the Constitution, as:
The facts related to rights in the election process do not constitute serious violations of the Constitution.
The facts related to relations with strategic partners do not constitute violations of the Constitution.
The facts presented as violations related to the independence of public organs do not constitute violations of the Constitution.
The facts presented as violations of order and public security do not constitute violations of the Constitution.
3. The facts presented as violations of Article 94 of the Constitution do not constitute violations of the Constitution.
For these reasons, the Constitutional Court of the Republic of Albania, based on articles 90, dots 2 and 131, points 1. 8577, 1002.2000 “For organising and functioning the Constitutional Court of the Republic of Albania”,
