The Bureau for Confiscating Riches could be completed again at Venice Commission

The two largest opposition parties LDK and PDK consider that the Bill for the State Bureau for Verification and Confiscating of Inexcusable Riches is another act of populism on the part of power, rather than efforts to functional it in the justice system. According to the opposition, all recommendations by the Venice Commission cannot be included through amendments. However, the opposite is said by power aimed at sending the same bill back to “Venecia”.

Democratic League of Kosovo MP Driton Selmanaj says Venice's remarks to the Bureau are so serious that the Parliament is impossible to address them. He says the government is insisting on this law only for face and face.

Even PDK deputy Hajdar Beqa agrees that through amendments all the opinions of “Venecias” for this legal initiative cannot be addressed.

Beqaj, who is also a member of the Commission for Legissation, adds that this law cannot enter into force without becoming zero.

“I consider that the position has no interest in making this law and putting it into function and in the life of the Republic of Kosovo, is more seen as the popularity of Mr. Kurti and Mrs. Haxhiu, or a campaign promise and we are willing to do it, but these are not leaving us, and this is some form of view of the face of this government we now have. I consider it possible to participate in public hearings, but we are wasting time because this law cannot enter into force without turning to zero to withdraw from the minister of justice, come a new matter, in constitutional spirit and then give other actors, in this case the opposition, its contribution. Beqaj warned that the same bill would be sent to the Constitutional Court for assessment of constitutionality.

It is impossible for this law not to go to the Constitutional Court, and I think it must go and I am very optimistic that it will be sent to the Constitutional Court even by the PDK because we cannot allow a law that is contrary to the constitution of the Republic of Kosovo to enter into force to possibly damage the very purpose of the law or harm the citizens of the country. I think with automatism seeing all the violations the Venice Commission has ascertained it must go to the Constitutional Court and it will bring down”, Beqa stressed.

Justice recogniser Ehat Miftaraj considers that if comments from “Venecias” are taken on basis The State Bureau bill will completely distinguish from the one who passed on the first reading. He says it is difficult for the parliamentary Commission for Legislation to meet all the standards required.

Now we are in a situation where the Commission is going to have to have a large number, we can say with dozens of comments from the Venice Commission and civil society, address it through amendments to the law, which happens to be almost every article in this law to be amended. In this regard it is important that the Co-operative Group in the Commission do the job slowly and deal with all that has been said by the Venice Commission so that this law will then not be contested and subject to the Constitutional Court or be brought down by the Constitutional Court because of restrictions on human rights and freedoms or other constitutional violations... If comments are taken on the basis of énecia and civil society, we will have a completely different law from the bill that was adopted in the first reading. This gives evidence enough of how many mistakes have been made in the current draft that was adopted in the first reading”, Miftaraj said.

Vetevendosje Movement MP, once chairman of the Commission for Legislation Adnan Rrustemi, says all recommendations that have emerged from the Venice Commission will be addressed within the processing group. He said they are interested in sending the report with amendments to the Law for the Bureau back to the Venice Commission for opinion.

The Legislation Commission has established the working group that will deal with Article for Article, of course in light of the recommendations of HINAVenecias. As we have said, we are determined to address all recommendations of the Venice Commission now the working group has maintained direct work by treating a worker under the law, as well as points to the opinion of ʹVanecias. I personally have submitted 22 amendments to this bill that we are discussing... We expect to address this bill as soon as possible and of course we are interested in bringing the report by amendments back to the Commission.

Venice to assess whether the recommendations previously issued have been addressed... The opposition should come and participate in working group meetings and contribute to whether they already care about whether the recommendations of BARVanecia are being addressed. Otherwise they have other motives why they oppose this bill and against the Bureau”, he said.

The State Bureau for Verification and Confiscating of Inexcusable Riches bill has been adopted in the first reading in July of this year. The bill received the support of 58 deputies until there were 3 abstentions. For this legal initiative, the chief speaker, Glauk Konjufca, and the then power deputy, Doarsa Kica, who has recently moved to LDK, abstained.
