6 Istog municipal officials charged with corruption declared in court

At Monday's initial hearing, at the Constitutional Court in Pec, the high-ranking indictees were acquitted, who the Peja Prosecutor is charging with charges of misusing official duties, confiscating interest as well as falsification of the official document, reports the “Bet on Justice<1>.

At the initial hearing, the defender of the accused Elfette Blakaj, lawyer Sali Mekaj, proposed that procedures be singled out to protect him, since, according to the indictment, her works have nothing to do with other defendants and other people's actions have nothing to do with his protection.

In this regard, State Prosecutor Joy Vuqataj said the court is competent regarding actions of isolating or uniting the procedure, which left such a proposal to the court.

Afterwards, the chairman of the court, Murat Hulaj, found that the painful competence had been in the General Department, in terms of patience, but, according to him, was ranked within the framework of the Randa Crime Department, but if there is a reason for this situation again, he said he would again appreciate it.

On the other hand, after the parties proposed that the indictment be considered read, the prosecutor Vuqataj agreed.

Later, accused Yasar Blakaj, Rrustem Gashi, Rexhep Blakaj, Elfette Blakaj, Isa Hoxha and Besart Dresaj, each separately, said they feel no guilt over the charges they charge.

Afterward, Judge Hulaj announced to the accused on the request to drop the indictment and reject the evidence, where he scheduled the second review hearing on November 25th of this year.

Otherwise, the indictment set up by the Constitutional Prosecutor in Pec, September 7th, 2022, is charging Yasar Blakaj, Rrustem Gashi, Redzepkaj, Elfette Blakaj, Isa Hoxha and Beshart Dresaj for criminal acts “KEqq use of official tasks”, “Conflict interest” and “Falsification of the official document”

According to the indictment, defendants Yasar Blakaj, Rrustem Gashi, and Rexhep Blakaj, on October 16, 2020, at the facility of the Istog municipality, acting as co-chairman and exploiting official office exceed their competencies in order to benefit the other person in the amount exceeding 5 thousand euros.

According to the indictment, defendant Yashar as director of the Directorate for Urban Planning and Environment, while defendant Rexhepi as the head of the Urban Planning and Rule Sector, while defendant Rrustem as an official for Spatial Planning and Construction, issue a decision for the construction of the multi-resident and business building with BP5K eras on economic subject “NNT NOKI”, owned by/investor Arbnor Nurqaj and one contrary to Article 3,17, and 18 of the Construction Law, Urban Regulatory Plan “Istgu”.

What they did in interaction with criminal work “Using official position or authority” by Article 414 par.2 related to par.1 and Article 31 of the KPRC.

In addition, according to the accusation, from September 28, 2020, across November 04th 2020, in the municipality of Istog, defendants exceed their competencies in order to benefit the other person in the amount exceeding 5 thousand euros.

Where, according to the prosecution, in high-ranking directorate, initially the economic subject “Euroy Steel”, owned by/investor Shefqet Kabashi, and Ylber Blakaj, release construction conditions with number 11-95/20 with etage B+5 K + KT, and then construction permits for construction and that contrary to the Law for Building.

Also under the indictment, on December 14, 2020, defendants issue construction permits as mentioned above, for the residential object with the S+P+2K eagency, for economic subject “Beni S. P. K”, with owner/investor Agron, Arben, and Ardian Nimanaj opposing the law.

According to the indictment, the same on April 2021, exceeding their competencies and with the goal of profiting wealth and 5 thousand euros, issue a decision on building permits with many residential units with the Efficiency P+4 K + KT for economic subject “Sweis LB Invest”, owner/investor Visar Blakaj, with which investors allow the growth of ethnicity at the same facility by enabling the profit of wealthary benefit through increased ethnicity for two stories, entirely worth an invesity of 862,877.31.

Always according to the prosecution, from April 12th 2021, across April 26, 2021, as in the uppers, issue a decision on setting construction conditions for investor Osman Kraja, for building the multi-resident and business building with the B++2K eagency with the possibility of continuing, for investor Osman Kraja, contrary to the law.

Again, on May 28, 2021, defendants in the same country issue a decision on building permits to many residential and business residents P+5 K + KT, for economic subject “Stradard S. P. K”, owner of the Januzaj Salats, against the law, and despite the fact that the cadastral drive is located in the block where it is not defined and the area in question has been ascertained mixed residence and expansion space in the future, allowing wealth to be obtained with the growth of four-story equity area and implementation of the project worth 2,805,008.05 euros.

With what co-operation they committed a criminal offense “Using official position or authority”, by Article 1414 par.2 related to par 1 and Article 31 of KPRC.

According to the indictment, defendant Elfette Blakaj, on September 21, 2018, in the facility of the Istog municipality, in the quality of the official person responsible for the environment with the Directorate for Urban Planning and Environment, personally participates in official matters that a member of her family has financial interest.

The charge is said to be responsible for the environment near the directorate in question, economic subject “Euro Steel” S. The P.K, in which co-owner is Ylber Blakaj, brother-in-law of the defendant, releases and signs environmental permission by which the investor is recognised the right of environmental permission to build the afaristo-bane with B+P5K etage.

The defendant also, on August 5, 2019, in the same country, in the same country, the economic subject “ro Steel”, the USP, her brother-in-law, is issued and signed the environmental permission by which the investor is recognised the right of environmental permission to build the apharisto-bane object with the etivity of S+P+4+KT.

Again, on October 15, 2020, the defendant of the same subject is issued and signed the environmental permission with which the investor is recognised the right to environmental permission for building the apharisto-bane object with the Etage B+5+KT.

Of what it is said he has consistently committed criminal work “Conflicted Interest”, from Article 417 par.1 related to KPRK Article 77.

According to the indictment, defendants Isa Hoxhaj and Rrustem Gashi, on July 27, 2018, at the facility of the Istog municipality, acting as co-creasors and using official duty, exceed their competencies with the aim of benefiting the rich benefit of Urban Planning and Environment, while defendant Rrustem as official for space planning and construction close to this directorate, release construction permits for construction of the afarist-baner object “Cculo <1x1>, with S5+Pe+i+i+ire for economic subject <Gran>. K.” owned by owner Ismet Loshi, acting contrary to the law.

What they reportedly committed in criminal co-operation “

According to the indictment, defendants Besart Dresaj, Rexhep Blaj and Rrustem Gashi, on June 28th 2019, defendant Besart as director of the Directorate for Urban Planning and Environment, defendant Rexhepi as leader of that sector, while defendant Rrustem as officials in this director, issues a decision on construction permits for the apharisto-bane project “Blo D”, with S+6+ KT, for economic subject “Granit S.P.K. owned by Ismet Loshi, acting contrary to the law.

On April 10th 2019, the same issuing a decision for construction permits for residential buildings, for investor Rifat Mirana, acting contrary to the law, as well as allowing the implementation of the project worth 671,089.18 euros.

What it says co-operation has been done in paneling “Using official position or authority”, by Article 1414 par.2 related to par.1 and Article 31 of KPRC.

According to the indictment, defendant Rexhep Blakaj, on November 12th 2019, in the same place, as leader of the Urban Planning and Adjusting Sector, personally participates in official issues for which he has been aware that a family member has financial interest, and the defendant with the case of setting up according to requirements for the apharisto-ban building for allowing continued construction by B+P4 + KT in B+P+6+ KT for investor “Sweiss LB Invest”, with investor Visar Blakaj, and the same participates in signing construction permit.

Also from June 19th 2018, as of October 16, 2020, the defendant takes a personal part in official matters for which he has been aware that a family member has financial interest, for investor Arbnor Nurqaj, signed construction conditions and permission for the construction of the afaristo-bank object, where project manager had been the son of the defendant, Faton Blakaj.

By April 26, 2021, the defendant decided on request for investor “FNO-KRAja” S.P.K. (Dominor Fetah property owner) signed construction permits for the afaristo-bane construction, where design studios work, the manager of the Faton Blakaj project, and the shareholder son of Brother Blakaj and his son, Arian Blakaj.

Also on February 21st 2019, the defendant, for Rifat Mirana, releases building conditions and permits, even though the same has been known that the project has been drafted by studio “Arch-Art”, where his sons are employed, while the project manager Faton Blakaj, who is the son of indictee Rexhepi, and the same object was built by economic subject “AR-Beton”, where his son, Arijan Blakaj, and brother's son, the Blakaj Consort.

What it says in the indictment is that he has consistently committed criminal acts “conflicted interest”, from Article 417 par.1 related to KPRK's Article 77.

Always according to the indictment, defendant Rrustem Gashi, on November 12th, 2019, as officials oversteps his competencies according to the position he carries by setting his signature on the decision for construction permits for the US investor. P.K “Sweiss LB Invest”, instead of signing for Director Besart Dresaj even though he was not authorized for such an act.

Again on November 2nd 2018 and May 13th 2020, he places his signature on construction permits for the investor “Granit. P. K”, instead of the director, even though he wasn't authorized for such an act.

While on June 22, 2020, he again puts his signature on the decision for construction permits for the N.T. investor. S. “B. P Bala- Petrol” owned by Necdet Balaj, instead of the director, giving construction permits and issuing a decision for construction permits.

What they say he committed a crime “Falsification of the official document”, by Article 427 par.2 related to par.1 of KPRK.
