Thus is praising Justice Minister Albulen Haxhiu, who in an interview for the EO, said they have already started working on drafting the bill to establish the institute, where all crimes that have occurred during the war in Kosovo will be documented.

According to her, the prosecution has free hands to act in this direction for the fact that Serbia does not hand over war criminals.

Kosovo still doesn't have an institution that we can have documented war crimes and in this direction nothing has been done. We had a war crimes institute, but it was decided so not by law, and there were human capacities in the same way to make the record of war crimes. In this direction we have started work on drafting the Bill for the Founding Institute that will document all crimes that occurred during the war in Kosovo”.

“was formed the working group after passing the document concept to Government to get a clear picture of the situation in this direction. The processing group is meeting to discuss this institute. We have also increased the capacity for the Special Prosecutor for Procures to deal with war crimes cases and the strategy for transitional justice, and we have eliminated the shortcomings that have been in the Criminal Procedure Code for Judgment in the absence of Serbian criminals. The prosecution has free hands to act in this direction for the fact that Serbia does not hand over war criminals. But with our legislation in absentia, they can be punished and then sentenced for the crimes they've committed”.

She added that the party she represents has strongly opposed the establishment of the Special Court because it is presenting a distorted mirror for the fair fight in Kosovo.

However, Haxhiu stressed that they will see all alternatives to what they can do in terms of the “implementation of this court says Kosovo has closed its doors with the amended amendment for foundation in the Constitution.

“One of the main subjects in Kosovo is the VV that has rejected the establishment of the Special Court. Just because we have considered that the special court will present a distorted mirror for the fair war in Kosovo. But even in spite of our opposition to the Constitutional Court, I haven't had a chance to stop it”.

We've been locked in the door for any other action now because as you're aware the Special Court has entered the Constitution and we can't even remove the Justice Ministry has closed any aspect of the Special Court except we have the Department for Legal and Financial Protection of Persons in The Hague and we're carrying out our responsibilities in relation to defence”.

“... we'll look at possibilities like Government for having had a visit and had it impossible to go and we have their complaints in the absence of transparency we've addressed them to the lawyer and we see whether they're being respected or not. We'll see other alternatives to what we can do in this direction, but I'm not very optimistic that Kosovo has any way of closing our doors with the amendment in the Kosovo Constitution”.

Haxhiu has said they are working in terms of drafting constitutional amendments to the Vetting issue in the justice system.

She even said she has invited political subjects to separate meetings to discuss vetoation because amendments can only be voted if they have two-thirds of Albanian deputies, and on the other hand two-thirds of communities representing non- majority citizens.

“in the governing programme we have vetoing in the justice system, also at high police levels, but this is the responsibility of the interior ministry. At the highest level of customs, AT K, AKI because we believe that they are sensitive and also important institutions and in this direction we are working in terms of drafting constitutional amendments to the property issue in the justice system. We're also expecting an opinion by the Venice Commission in the paper's concept report, but as the responsible members are handling the concept issue we once finalise the amendments we will proceed for opinion from Venice because it is important to act in line with European standards”.

And of course we need support from the Parliament because the amendments can be voted in only if they have two-thirds of Albanian deputies and on the other side two-thirds of communities representing non- majority citizens. I have invited political subjects to separate meetings, but also joint ones because I consider it important that we have consensus. I have not been able to meet with the opposition, including the Serbian List parliamentary group”.

Haxhiu said the government wants Kosovo to be a rule of law because, according to her, whatever criticism is done to the justice system occurs due to scandals, and with this case, a barricade and groundless charges are created.
