Freed even the last person, case “Proto” ends up with no convict

Gashi had been released from the Constitutional Court in Pristina, but was convicted by the Court of Appeals. The latter had sentenced him to one year and four months in prison on bail, which until that verdict was the only one of the 11 indictees in this case with a conviction act, reports “Justice Vought”.
To this decision, his protector, lawyer Guzim Kolqaku, had applied for protection of the legality of the Supreme Court, which with the decision of November 22nd 2021, provided by “Justice Vow”, has approved this demand of the defenders and has decided that Gashi eventually be acquitted of the prosecution of criminal work “the violation of the equal status of citizens and residents of the Republic of Kosovo<3>.
Otherwise, the Constitutional Court in Pristina on 3 January 2020 had declared a free trial against 11 indictees in the case known as “Proto”. But the Court of Appeals, on June 30th 2020, had partially changed the first degree act in the case of “Proto” and convicted Ademi Grabovcin, Ilhami Gashi and Sedat Gashi for criminal work “The violation of equal status of citizens and residents of the Republic of Kosovo”.
Adem Grabovci Apelci had pronounced the sentence uniquely of 1 years and 2 months in prison, a sentence that would not be executed unless he performed another criminal act, in length of 2 years. Grabovci was also denied the right to be elected and prohibited from exercising functions in public administration or public service, in length of 2 years, following the passage of the period of bail verification, reports the “Justice bet”.
Ilhami Gashi had been pronounced a unique sentence of 1 year and 4 months in prison, which the sentence would not be executed unless the same was committed by another criminal act, in length of 2 years. He had also been denied the right to be elected and had been barred from exercising functions in public administration or public service, in length of 2 years, following the passage of the period of parole verification.
While Sedat Gashi had been sentenced to prison terms for eight months, which would not be executed unless the same one committed a year-long criminal offence. He had been denied the right to be elected and had been barred from exercising functions in public administration or public service, in length of 2 years, after passing the period of parole verification.
And for others, Besim Beqajan, Zenun Pajazit, Nijazi Kryeziu, Arbenita Pajazit, former Secretary of the Ministry of Internal Affairs, Fatmir Shudren, Ismet Nezirajn, Xhafi and Raj Abaz, Apel has rejected the Special Prosecutor's complaint of the Republic of Kosovo (PSRK), proving the first-degree liberation act, reports “Betim for Justice<2.
To that decision, the parties had filed a complaint with the Supreme Court, which on September 29, 2020, had confirmed the Court of Appeals Act of June 30, 2020.
However, after the parties had filed a plea for protection at the Supreme Court in April 2021, this court in April 2021 violated the act of Court of Appeals, June 30th 2020, and that of the Supreme Court, of 29 September 2020, for the punitive part of the “Proto” case, by which they have annulled the sentences imposed on the former Democratic Party of Kosovo's deputees, Ademi Grabovci, and for Ilham Gashi and Sadat Gashi, had returned him to the case of restoration.
The Court of Appeals in September 2021 had announced that it has partially changed the court's act of first degree only in terms of Ilhami Gashi, while as of Grabovci and Sadat Gashi, this court had announced that it has refused the P complaint as unconfirmed.
