Fight for ISIS, accused of terrorism says he is repentant

The accused of terrorism, Fidan Demolli, has pleaded guilty and is repentant that he fought for ISIS.

That admission of guilt was made Tuesday, at the Special Department of the Foundation Court in Pristina, after the same was read the indictment on the part of special prosecutor Africa Shefkiu, reports the “JusticeBetim”.

Demolli has said he is found guilty of committing the criminal act of terrorism, as stated in the police and prosecutor.

His defender, lawyer Jeton Partuzi, has said the accused Demolli had consulted him sufficiently about the consequences and benefits of admitting guilt, so the same one has asked the court to approve this plea.

Even special prosecutor Africa Shefkiu, who has claimed that this guilty plea is complete and in accordance with legal provisions, has accepted it.

In this way, Judge Shadije Grguri has approved this guilty admission.

Regarding the serious and extenuating circumstances that will be taken into account during the measurement and pronunciation of the sentence, prosecutor Shefkiu as a facilitator has cited the guilty's guilty plea, the family situation, and the repentance of committing a criminal act.

While prosecutor Shefkiu's exacting circumstances have cited the burden of criminal acts, the extent of the accused's criminal responsibility, the manner of committing criminal acts, as well as the chronology of travel to end as a foreign terrorist fighter.

While Demolli's defender, the lawyer Jeton Partuz, has asked the court to take blame, his co-operation with justice organs in all phases of the procedure, the poor economic situation, which, according to the lawyer, has influenced him for a better life to go to Syria after having been promised good salaries and child additions.

The lawyer Partuz as another circumstance has also mentioned the defendant's deep regret, the fact that he is the father of six children, poor health, his stay in custody in Syria, which according to the lawyer has been persecuted.

He has also demanded from the tribunal that in his pronounced sentence, his time spent in prison in Syria and in Kosovo's High Security Prison is calculated.

I'm sorry for my actions, I don't have a good state of health, I promise I'll never repeat a criminal act”, the accused Demolli recently said.

The announcement of the indictment will take place on January 20th, 2022.

According to the indictment filed on December 15, 2021, accused Fidan Demolli in August 2014, in order for you to join the terrorist organisation I SIS in Syria, along with the person Ardian Hyseni, from Pristina through a border crossing of “Elesi's Hanini”, had infiltrated northern Macedonia.

As reported in the indictment, then via Bulgaria had arrived in Turkey- Istanbul and then in Gazientep and after contact with Burim Demolli had penetrated inside Syria and registered at I The SIS was equipped with AK47 automatic rifles, and after his combat exercises, he shared in the wars in Syria.

According to the SPRK, then the same has been handed over to the Syrian Democratic Forces, where it has stayed until July 17th 2021, with cʹrast being repatriated to Kosovo.

For these actions, Demoll is being tasked with criminal work “Organising and participating in terrorist group”, by Article 143, paragraph 2 of the Republic of Kosovo Penal Code.
