Appeal confirms indictment against former Klokot Mayor

The Appeals Court has ruled the Special Department of the Foundation Court in Pristina, with which the indictment for violating the free voter definition against the former head of the Klokot municipality, Bozidar Dejanovic was confirmed.

He is accused of having influenced the Serbian “List's vote” and his favourite candidates from this subject, in the February 14th 2021 national elections in the Republic of Kosovo.

The “Justice Vow” has secured Appel's decision on this case, in which allegedly the complaint of accused Dejanovic's defender, lawyer Elmi Qerim, has been denied.

According to Appeal, the first instance court has justly given sufficient reasons that the indictment filed by the Special Prosecutor of the Republic of Kosovo (PSRK) has sufficient evidence to support the well-based suspicion that Dejanovic has committed the burden-ridden criminal work.

The appeal has seen as unstable the claim of protection in terms of evidence that the same do not offer qualities, credibility and importance. According to Appeal, such claims at this stage do not reflect on merit deployment, reports the “Justice Trust”.

This court draws attention that this stage of the criminal procedure deals only with the legality of the criminal procedure in terms of creating a based suspicion, while for assessing the test is the stage the court implements in the phase of judicial examination”, the Appeals decision is said.

At the end of Apel's decision, the first-instance court has reportedly acted justly when it rejected the defence request to drop the indictment and counter the evidence, since according to Apel, the complaint claims of defence at this phase of criminal procedure were deemed groundless.

“While there are no initial legal reasons for dropping the indictment and rejecting evidence, just as they anticipate the legal provisions for dropping the indictment and objections of evidence, just as they envision the legal provisions set forth by Article 250 par.1 under paragraph 1.1, 1.2, 1.3 and 1.4 and 249 of KPP”, it is said in the Apel decision.

Otherwise, accused Dejanovic was declared innocent at the initial session held on September 16th of this year.

The Special Prosecutor of the Republic of Kosovo, on 2 July 2021, has filed charges against Bozidar Dejanovic, who is charged with committing criminal work “Cenim of the free-determition of voters”, from KPRS Article 210.

According to the indictment, accused Dejanovic in the quality of Klokoti municipality chairman on February 12th, 2021, deliberately and with the aim of violating the freedom of determining voters in the national general elections held on February 14th 2021, for electing MPs from the parliament of the Republic of Kosovo have seriously affected the workers of the Klokot municipality.

Also, according to the indictment, accused Dejanovic has misused citizen's economic dependence Zoran Rodiq has influenced him to vote for the political subject “Serbian List”.

The defendant reportedly organised several meetings with municipality officials on the day of the incident, where 15-20 people attended each meeting, ordering them to vote in elections that were to be held after two days on the Serbian “List”, telling them to vote his favourite candidates with 1,2,5,6 and 7 of this subject.

Later in the indictment, official Zeyan Vlajkovic, the accused ordered him to keep records of the investigation, while the audience has demanded that they be declared from how many votes they have from their family, and until official Vlajkovic was IDating the data, the accused had handed out to the audience the papers with different colors of paper and chemical, which he later identified in the process of marking the link between the person/color and the complete audience, with words that no one would vote on his orders, because he had no specific consequences for the job, who had no plans to identify each person with the command.

In the indictment, it is said that on the day of the incident, the accused had called to his office the citizen Zoran Rodic, who has demanded to vote on the political subject “Serbian List” and for candidates to vote on the number of 1,2.7.8 and 9, and rather the accused has demanded from the person in question that the subject and the recommended candidates vote on him and his entire family.

Always according to the charge act, the citizen Rodic asks the accused to know who these people are about, the accused tells “you need to listen, because I helped you... I replied that what you helped me, the mayor told me that I gave you a package of food assistance...”, by whatever they used to use his economic dependence, the accused influenced the free will of Zoran Rodiq as a voter.
