On a proposal for Periscope, Kosovo Institute for Justice Executive Director Ehat Miftaraj says that if the Gjilan municipality's decision is in terms of implementing the government's decision that limits only public officials, is in accordance with the law, but if this decision applies to citizens seeking municipal services, then this decision can be considered ardor and restricting rights to citizens of this municipality.
“Based on the Law on Prevention and Fighting of Pande COVID-19, is the Government of Kosovo and the Ministry of Health that can make such character decisions. If the Gjilan municipality's decision is in terms of implementing the government's decision that limits only public officials, it is in accordance with the law, but if this decision applies to citizens seeking municipal services, then this decision can be considered ardir and restricting rights to citizens of this municipality”, Miftaraj said.
On the other hand, the executive director of the Council for the Protection of Human Rights and Freedoms [ KMDLNJ, Behxhet Shala told him Periscope that, in an extraordinary situation, extraordinary decisions can be made.
“Z. Haziri is allowed to make these decisions because if these decisions are not made, the situation is going through. After all, extraordinary decisions can be made in an extraordinary situation. And we can't talk about human rights at a moment if it's a fair question of life. The right to life is the supreme right. If it is not reflected or protected, then it is inconsistent to talk about other rights. Because we're in a serious situation and interests are in order, because if we were vaccinated over time, if there had been greater discipline, we wouldn't have so many of the dead and the infected”, Shala said.
Otherwise, the overall situation in Gjilan from the beginning of the pandemic is the following: out of 26111 samples, 9331 citizens have proved positive, 8160 have recovered, 174 people have lost the battle, 998 cases are active, 49131 so far were vaccinated, hospitalised are 111 patients, while 146 samples are pending results./ P ERISCOPI/
