Bajram Velija, who is being charged with killing his wife in August 2019, has demanded an easy sentence from the court, since he said the murder was committed by accident.

Such a thing Velija has asked at Wednesday's session held at the Constitutional Court in Prizren, during which the final word was given, reports “The Justice Vow”.

Initially, prosecutor Ervehe Gashi said the actual situation has been proven, as described in the indictment, adding that the motive for committing a criminal act was the preliminary dispute the accused had here with the deceased.

Prosecutor Gashi has stated that in the actions of the accused there has been a direct will, with the argument that the same had been determined to commit a criminal act, and that in this regard he had not found extenuating, but only burdensome circumstances.

The same was demanded by the court that the accused plead guilty and pronounce the maximum sentence, envisioned under legal provisions.

The prosecutor's final word was supported by the representative of the damaged party, lawyer Arian Koci.

Lawyer Koci said the case in question is the most serious since the post-war in Kosovo, after the murder has been seriously, brutally, accused of justice and has not asked for forgiveness.

According to him, the sentence for the accused should be life in prison and be a lesson in society so that such cases do not repeat themselves.

On the other hand, the defender of the accused Bajram Velija, lawyer Orhan Rekathat, said his defender did not deliberately kill his wife, but for this were verbal disputes between them, and that's because the same was in the influence of nervousness and effect.

The same said that Velia had cared for his wife financially and that he had not been problematic, had not been in bad conduct, nor had any psychiatric disorders.

According to the lawyer, from evidence in this criminal case, to the accused's actions there is no indication that there has been motive for preparing the criminal act, which he said witness statements have confirmed.

In the end, lawyer Rekathat demanded an adequate sentence from the court for the accused Velija, in view of his behavior, co-operation with justice organs, and his deep regret.

Meanwhile, the accused himself said there has been no disagreement with the deceased, but that they have had a good life.

He apologized to all his family and daughters, adding that nothing had been planned on this occasion but that at that time there had been words to him that were unpleasant and that I don't know what had happened to him that day.

Finally, the accused Velia demanded from the court a sentence as easy as possible for age, suffering from certain chronic diseases, repentance, and the fact that he had no intention.

After hearing all parties, the head of the court, Judge Raima Elesi, has appointed the plea on October 1, 2021, at 09:00, reports the “Justice Bettim”.

Otherwise, according to Prizren's Constitutional Prosecutor's Act, compiled on 28 February 2020, Bajram Velija is charged that on August 6, 2019, in the neighbourhood of “New Life” in Prizren, he deliberately deprived his family-wife, A.A.

According to the indictment, after a preliminary disagreement with the victim, the moment the victim was leaving their home, the defendant is equipped with a pistol and fired 15 times toward his wife, striking him 14 times in different parts of the body.

After carrying out this action, the defendant covers his wife in a dress and awaits the arrival of the police.

Bajram Velija is accused of committing the crime of serious murder, which is sentenced to no less than ten (10) years in prison or to life imprisonment

According to the second point of the indictment, it is said that by August 6, 2020, the defendant holds in ownership and control of the type pistol “Pytro Beretta Gardone”, several caricators and bullets, contrary to the applicable Law regarding weapons, with which the prosecutor suspect the criminal act of the serious murder has been committed.

With these actions, the accused has, according to the indictment, committed the criminal act of ownership, control, or unauthorized possession of weapons for which the penalty of up to seven thousand and five hundred (75) was envisioned. Euro or prison for five years (5)

Otherwise, defendant Velija has been in custody since August 6th, 2019.
