Otherwise, according to the indictment, on November 9, 2002, in the waiting room of the joint family residence on the Dietrichstrace No.4 street at Bad Oeynhouse, Republic of Germany, Afet Gunter Vila. He had deliberately deprived his wife Irene Gunter of life after repeated disagreements with the deceased over a year of living together in the apartment.

The indictment says that because of the jealousy that the defendant had toward his wife, which he suspected was cheating on other people, on the critical day the defendant had tried to call him several times, but his associate Irene had not been notified after forgetting the phone at the apartment until with her friend Diane had gone to rent some CDs with films.

According to the indictment's device II, the defendant is charged that on the date, time and place of the same as in the first device of this indictment, he had deliberately caused bodily harm to Helene Gunter (the daughter of the late Irene Gunter), and Diana Kuchler (the late friend of the deceased), in a way that while the defendant was now arguing with the deceased, damaged Diana Kuchler had attempted to call the police over the telephone.

The 20 - inch - long [20 cm] - long kitchen defendant had then hit the injured Diana Kuchler on the right side of his chest by causing cutting wounds, tamgenial pricks, which had caused slight bodily damage, with temporary effects on the injury.

On the other hand, the defendant had then hit the late Hellenic Gunter's daughter, on the side of the womb, causing cutting wounds on the left side of the abdomin with the damage to the thin intestine, arterial bleeding, apendix damage to the apendix, retroperitoneum, with operational interference, removal of a piece of thin intestine and agrix, which caused serious bodily damage, dangerous to the life of the injury at the moment of causing.

With this he committed the criminal act “Plagos of the North” by Article 38 paragraph 2 of the KSAK Criminal Law (official journal number 20/77), which was in effect at the time of the commission of the criminal work.
