The panel, scheduled for the case of former heads of the War Veterans Organisation, Hysni Gucati and Nasim Haradinaj, has continued the detention measure to these two.
The decision reportedly says that the Specialised Prosecutor's Office, by October 8th, has the deadline to pre-empt the parachutes over the upcoming review of Haradinaj's Gucati detention. Meanwhile, the defence until October 15th has deadlines to respond to the prosecution.
According to the court consisting of Charles L. Smith III, Christoph Barthe, Guénawl Mettraux and reserve Judge Fergal Gaynor, still have reasons for continuing detention.
They have considered that the dangers of obstructing the procedure and carrying out criminal acts or repeating the criminal acts Haradinaj's Gucati, which they have earlier threatened to carry out, can be effectively managed only in the detention facilities of specialised rooms.
Otherwise, on September 1st and 2nd, at 10: 00 p.m., preparation conferences are expected to be held in the presence of the Specialised Prosecutor's Office (ZPS) and defence.
Meanwhile, on the basis of the announcement on the official site of Kosovo's Specialised Chambers in The Hague, the court has also decided to temporarily set the date of the preparation conference for the Specialised Prosecutor, on September 8th and 9th 2021.
The preparation conference for the trial is regulated by the 117th rule of Kosovo's Procedure Adjust and Tests of Specialised Chambers.
Hysni Gucati, along with Nasim Haradinaj, is being charged with criminal acts against justice administration, specifically with obstructing official persons in carrying out official duties, fearing witnesses, taking revenge and violating the secret of the procedure, reports the “Justice Voughty”.
The “The charges presented in the confirmed indictment rely on well-based suspicion that at least between 7 September and 25, 2020, Mr. Gucati and Mr. Haradinaj uncovered without authorisation protected information from the Specialised Chambers Law, among which identifying data of several (possibly) witnesses, in three press conferences and other broadcast activities, as well as further distribution involving statements on social networks”, it was said in the announcement of the Specialised Chambers.
Gucati and Haradinaj are charged with making derogatory comments against potential witnesses and repeatedly expressed their intention to undermine the work of the Specialised Chambers.
With these actions, Mr. Gucati and Mr. Haradinaj violated the secret of the procedure and feared witnesses (possibly) of the Specialised Prosecutor's Office and subsequently prevented the work and investigations of SPS.”, the Kosovo Specialised Chambers announced.
