The Constitutional Court in Pristina has dismissed the indictment brought against the deputy and deputy head of the Kosovo Parliament from the ranks of Vetevendosje Movement, Saranda Bogujevci, for obstructing the official person. It charged that in November 2015 it had prevented the work of a police officer, who had not allowed the MP to cross a blocked street in Pristina.

Such a court ruling turns out it was issued on September 30th 2020.

Otherwise, Pristina Constitutional Prosecutor on November 17th 2017 had filed an indictment against Bogujevci for insisting that, at any cost, go to the “Mygeni” in Pristina, even though it was announced by police officials that this route was blocked and the same could not be passed, reports “Betim for Justice”.

However, after three years of the establishment of this charge, the court had decided to reject this accusation.

In the argument of the verdict, provided by “Justice Vowing” says that the Court after preliminary review of the indictment has found that the criminal act Bogujevci is charged for lacks the elements of the criminal record image, the use of force or serious overlaps, which is essential to carrying out this criminal act.

Under that decision, at the same time the Constitutional Prosecutorship in Pristina was withdrawn from the indictment.

“Po on 30.09.2020, the court accepted the official letter from the Constitutional Prosecutor in Pristina that the prosecutor of the case after analyzing the subject documents, found that in this case it is not a criminal offense, so he makes the withdrawal of the indictment”, the court ruling.

The decision also states that such actions could qualify as an offense under the Law for public order and tranquillity, Article 16.

According to the indictment filed by the Constitutional Prosecutor in Pristina on November 17th 2017, charged by Saranda Boguyevci was charged with criminal acts “obstructing the official person in performing official duties”, by Article 409, par.1 of the Penal Code.

As reported in the accuser act, charged by Bogujevci on November 28, 2015, on the “Mygeni”, in Pristina, had initially failed to comply with the verbal order of police officials who had been committed to blocking the road in question.

Always in accordance with the indictment, after the accused had asked police officials whether he could pass through that section, even though it had been announced that he could not pass, she had insisted that, at any cost, the policeman, now injured Ilir Rexha, had prevented him from carrying out his official duty.

The “Justice Vow” has attempted to contact the deputy head of the Republic of Kosovo Parliament Boguyevci, but the same has been elusive.

Criminal work “preventing the official person from performing official duties” is punishable by imprisonment of three (3) months to three (3) years.
