Minister Hajdari: Commercial court to offer relief to foreign investors

The Commercial Court is of extremely high importance. The establishment of the Commercial Court will help business. All issues related to businesses and disputes will be resolved in Kosovo, not to end up in international courts with arbitration clauses. Through the Comercial Court, it is planned especially in the economic reform plan that has been integrated as a measure in the ministry and trade plan. Investors may first come to the ministry to ask about the possibility of resolving their problems before addressing the Commercial Court. And if they don't make it to the Commercial Court, then they can go even further away from”, the minister said.

She said that in addition to some laws the ministry has postponed is dealing with many problems, trying to stop some criminal contracts against public money as they were in the field of oil and tobacco.
We have made a good scan at the ministry. We've found some laws that are good. There are processes that have been developed but we have found no policy documents regarding trade, industry and innovation and no export policy. Except for some laws we have postponed because in the first 100 days, we have dealt with many problems trying to stop some criminal contracts against public money like they were in the oil and tobacco field, Hajdari added.
And we've also put off administrative laws and guidelines in terms of facilitating doing business that is a total of 5 guidelines, two laws also the document concept of industrial property by 5 laws, the law on competition, inspections that will unite all inspections on an electronic platform. These laws will be updated with criteria for potential investors in Kosovo”.
However, Hajdari said they have also dealt with the 2020 administrative directive, which was outlawed -- a contract allowing oil monitoring in Kosovo.
On this issue, she added that they have turned to the police and the Court, adding that the prosecution is being taken over with the investigation.
“We immediately dealt with the administrative directive of 092020, and that directive was outlawed and as a damaging result had brought a contract allowing oil monitoring in Kosovo. This is not preceded in the old law, nor now in current law”, she said.
We haven't completely canceled the administrative directive because the contract with the foreign company represents the arbitrage clause and this could have cost us so we're addressing the Court Police to handle the investigation. The investigation has begun and are taking over from the prosecution and we will see the outcome of the”.
According to her, the Ministry of Industry and Trade has inherited a very modest budget where the Government's top priority will be employment and justice.
