Court's Reason for Haki Rugova Sentence

This statement, the Peja Court has put into writing the case for the conviction pronounced in June of this year on Rugova, who was accused of signing the contract for giving the tender to his brother.

Rugova was charged with signing contract with his brother's company, “, on August 1, 2014 Ma-Con” sh.p.k. for the construction of channeling for the villages of Cerca and Lubozhda, worth about 289 thousand and 119 euros and 85 cents.

In addition to the prison sentence, Rugova has been barred from exercising official functions in length of 1 year, following the end of the sentence.

In the act provided by “Justice Vowtim”, the Peja Court has argued that the administration evidence had confirmed that defendant Haki Rugova had acted contrary to public duty and private interests, when as mayor of the municipality, he had signed the contract that had been his brother, Gani Rugova.

According to the Peja Court, the company, which had won the tender in the Istog municipality, defendant Rugova had been co-owner until 2013, while according to the court the defendant's wife had also been in working relations with the firm.

“With what has committed criminal acts of conflict of interest because it has acted in disagreement between public duty and the private interests of the high official, where he has the right private interests for rights or indirect, personal or property, which affect the legality, transparency, objectivity and without its partiality during the exercise of the public function”, the Page Court's argument states.

Regarding the extent of the sentence, the Court has found it a grave circumstance that defendant Rugova as mayor of the Communists, with the conduct of the criminal act, has conveyed an offensive message to the opinion during the exercise of his duties.

The Peja Court argues that an effective prison sentence on Rugova is convinced, the purpose of criminal sanctions and preventing the defendant from committing further criminal acts.

The court took on the grounds that the defendant is either public face or by his actions, consciously violated the Law for the prevention of conflict of interest in the exercise of public office which in the opinion conveys an unkind message during the exercise of his public function”, the Court of Paya's education reported.

According to the court, the purpose of criminal sanctions will be achieved with this sentence, and the defendant will be prevented from committing any other criminal acts in the future.

Otherwise, on June 14, 2021, Istog Mayor Haki Rugova has been sentenced to an effective year in prison for the case where he was accused by the Constitutional Prosecutor in Gjakova of conflict of interest.

According to the trial pronounced by the court's chairman, Judge Sami Shadaku was also pronounced a supplementary sentence against him and that, the ban on the exercise of public office in the term of one year, reports the “Justice Vought”.

In addition, he has been obliged to pay the amount of 150 euros on behalf of criminal procedure, judicial pause and on behalf of the crime victims' fund.

By contrast, according to the indictment filed on March 26, 2018, by Gjakova's Founding Prosecutor, Haki Rugova is charged with acting as head of the Istog municipality on August 1, 2014, signing contracts with the company “Ma-Con” sh.p.k. for building sewers for Cerca and Lubozhdez villages.

According to the indictment, at the moment of contract binding for construction work done between the Istog municipality and the company “Ma-Con” sh.p.k. The company's director has been Gani Rugova, and the contract price has been 289,119.85 euros.

The prosecution's body claims that by these actions, accused Rugova has granted financial interest to his brother, Gani Rugova, so accuses him of committing the criminal work of conflict of interest.

Initially this subject was sent to the Constitutional Prosecutor in Pec, she had been delegated to prosecutor Haxhi Sinanaj, respectively.

But the latter, on January 17th 2018 with the letter, was addressed to former head of the Constitutional Prosecutor in Gjakova, Ali Selimaj, and after consulting with former Prosecutor's Prosecutor of Appeals Hadzi Derguti, as well as with Peja's chief prosecutor, Agim Kurmeha, the subject has been delegated to the Constitutional Prosecutor in Gjakova.

“The reason for sending this criminal case to the competence of this criminal case for defendant Haki Rugova is the fact that, in the same time that we have long known and are in social reports, so to be a fair and independent investigation, following consultation with Apel's chief prosecutor and the chief prosecutor of the Constitutional Prosecutor in Gjakova, we have agreed to send this criminal case to the authority of the Constitutional Prosecutor at Gjakova”, prosecutor Hadina Sinay wrote.

By contrast, Hakki Rugova, in the local elections of 2017, had won another mandate, for the third time, at the head of the Istog municipality.
