Counterfeit file for contracting over 8m euros for soldiers

The question of how the KSF's food supply contract has been reached to the point of about two years after the investigation into the Ministry of Security Force and Procureing Organisation (OSHP) is an investigation by the show unjustly produced by Radio Free Europe and the Law on Justice.

The Fight for Criteria

The fight for the planned contract, worth 9m euros for Kosovo Security Force food supply, started in April 2018, and initially four companies had entered the race for the contract.

After assessing the bids, the Security Force Ministry had deemed them responsible only for two groups of economic operators, N.T.P. “Global Paradise”; “Ciano Trade&Services” and N.T. P.T “Flort, Soor - AL, KPL, food” U.S. Mitrovica.

The contract had won the economic operator “Global Paradise”; “Ciano Trafficing&Services”, three times in a row, with a bid of 7,21,000 euros, which was 1,461,000 euros cheaper than the other operator.

This contract was contested to the Procuring Organisation by two other economic operators, including the company “Beni Dona Plast”, who had complained that the company “Global Paradise” had not met the criteria according to the tender.

Nesim Grabanica, manager at company “Global Paradise”, on the show "Unitia," has explained that, in the first case, when other operators have filed the complaint, they have been called to the criterion that requires a master or bachelor-level food technologist. As he says, the OSHP had subsequently cancelled the KSF Ministry's decision on contracting, despite the thought that its research expert has issued to this body.

“Analysis of the legal expert, which was done in this case, has given the right to our company, because we've asked for interpretations from the Ministry of Education, which is also confirmed to us that the federal level and master level, in relation to the technologist's diplomas, are the same, they have no changes”, Grabanica said.

The Security Force Ministry had three times in a row decided that the contract was awarded to the group of economic operators “Global Paradise” and “Ciano Trade & Services”, praising it as a responsible bidder, an assessment not even given to the company “Beni Dona Plast”.

According to them, this company had never before been able to argue on the necessary funding criteria of 10 million euros in the past three years, about the same or similar nature of contracts. For this criterion, “Beni Dona Plast” had been repeatedly declared irresponsible.

Also, at the last session in O HOP, representatives of economic operators “Global Paradise” and “Ciano Trade & Services” had offered evidence under which it claimed that “Beni Dona Plast” had forged documents, respectively, two ISO certificates.

These claims revealed at the O public session The DPS, they have not been taken into account by the OSHP panel.

During the OSHP session, the examiner of this body has not agreed to give contracts “Beni Dona Plast”, as according to him, he has failed to meet the legal criteria. He has demanded that the decision be annulled and the subject be restored to re-evaluation by the Security Force Ministry.

But that didn't happen. After completing this session, the OSHP has granted the Security Force Ministry the right to proceed with proceeding this contract for “Beni Dona Plast”. Finally, after five battles in the Procuring Organization, this contract ended in March 2020, in favour of Ragip Mustafa, owner of the company “Beni Dona Plast”.

Doubts raised for false ISO certificates

While in O Battles were under way between companies to win the 9-million-euro Security Force contract, in connection with allegations of counterfeiting ISO certificates offered by “Beni Dona Plast”, Kosovo Police Task-Forca Anti-Corruption, had begun collecting information to verify their currency.

At the time, representatives of the economic operator “Global Paradise” had also taken action to verify their currency.

Clearly, while this subject was being treated with complaints in O The EPS, the Constitutional Prosecutor in Pristina, had decided not to take investigative action regarding claims of ISO forged certificates.

Miftarian: Scandal, for Certain Interests

Ehat Miftaraj, executive director of the Kosovo Institute for Justice, estimates that this act of prosecution presents a scandal of its kind, creating the possibility of public budget abuse, which can be divided for companies that through counterfeiting, can be beneficial to millions of contracts.

Silence during the investigation

Regarding the allegations raised, the show "Unitia" requested clarification from the company “Beni Dona Plast”. This company's lawyer, Besnik Berisha, in a written reply, has said the case is being handled by the prosecution and that “s to keep the investigation into progress”, “will refrain from public presentations”.

Former OSHP leader Blerim Dina has declined to be interviewed.
