Former EULEX judge Malcolm Simmons, who has warned that he will soon report to the Kosovo Assembly on irregularities in the functioning of the European Law Rule Mission in Kosovo, has indicated what should be subject to parliamentary investigation.
Simmons has said that a parliamentary investigation, among other things, should be made for the surrender of EULEX to Serbia, files dealing with crimes committed in Kosovo, the EULEX side.

1. EULEX hands over to Serbia prosecution files regarding war crimes committed in Kosovo;
2. Recorded claims of intervention in criminal judgments;
3. The documented claims of manipulation of protected witnesses” wrote Simmons in a Twitter post.
Issues that should be the subject of a Parliamentary initiative:
1. EULEX had over to Serbia of production files associated with war crime commited in Kosovo;

Simmons has sought to testify before the Kosovo Assembly, as the European Union has said to distort justice in Kosovo.
According to him, the decision to listen to this evidence in the Assembly is an important test for rule of law in Kosovo, but also for the Parliament itself.

In the testimony of Simmons to the prime minister, besides political influences, EULEX's co-operation with the prosecutor in Belgrade, Simmons details and expresses dilemmas for the work of the Special Court. But David Schwendiman did not last more than two years.
