MPs from the Kosovo Assembly have unanimously adopted today the draft law on fulfilling and changing the Penal Procedure Code that will pave the way for investigating and judging war crimes in Kosovo.
For these changes, 68 deputies were expressed, none against and no abstention.
Since the end of the war, in 1999, war crimes have been investigated by foreign judges and prosecutors, while by 2015, Kosovo institutions have assumed this role.
Since 2000-2008, U n The NIMK has been the authority to address war crimes cases. This mission has filed charges against 3 Serbs, 19 Albanians and one Montenegrin, but for all these cases has condemned only one person for war crimes. After the UNMIK mission was completed, responsibilities in this area have been placed on the EULEX Union mission, which has been operating since 2009-2018. But this mission had executive competence until 2014.
EULEX during this period has filed war crimes charges against 11 Serbs, 39 Albanians, a Montenegrin and a community person RAE. While after passing competencies to Kosovo authorities in 2014, the Kosovo Special Prosecutor has filed a war crimes indictment against 39 people by June 2020.
Otherwise, some 13,500 lost their lives during the war in Kosovo, while 1,600 are still considered undiscovered.
