After reading the indictment by prosecutor Marze Ibrahimi, the accused Ramaj has pleaded guilty to the criminal act of misusing official office or authority, while for the criminal offence of the official document was acquitted.
For such an admission of guilt, the prosecutor Ibrahimi has stated that these works were performed in real union, and his position said he bases it on the Penal Code, at Article 80, as well as the criminal theory, respectively.
On the other hand, the defender of the defendant Ramaj, lawyer Rame Dresaj, has asked the court to approve this guilty plea and to defend him to pronounce a milder sentence, reasoning that the same has taken disciplinary action.
After statements by the parties, Judge Ajvaz has approved guilty pleas and has declared the condemnation of Ramaj, with which he was originally sentenced to six months in prison. However, with his consent, his prison sentence was replaced by fines of 1,500 euros, which he can pay in three installments.
And for the criminal offence of the official document, Judge Ajvazi said that by a separate decision, he will isolate the procedure.
He has also said that hurtful competence will be valued for this criminal act if it enters into the competence of the Randa Crime Department.
In this regard, Judge Ajvazi has stated that in the 10-day term, the parties can make their objections and request to cast the indictment.
Otherwise, Fehmi Ramaj was convicted by the Constitutional Court in Pristina on 9 March 2020, having pleaded guilty at the initial session of May 4th. He was sentenced to nine months in prison for two criminal acts.
However, against this act, the defender Rama, lawyer Dresaj, had filed a complaint after which the Court of Appeals had turned the case into a retrial, arguing that the procedural provisions for guilty admission were not respected.
According to the indictment compiled on December 27, 2019, Fehmi Ramaj is charged with using official duty, the quality of the official low-level school teacher, fourth-grader, has misused his official duty.
The indictment is said to have done so in order to benefit others, so that it has surpassed its competencies by interfering in the IX/1 class diary, where, according to his will, he had improved the existing grades of the second half anniversary of the 2013/14 school year in the class of Biology, without the knowledge of the subject's education.
The accused reportedly intervened in the scores of 11 students, including his son, and improving their grades, with what raised their average grade for all subjects and improved their overall successes.
By this, it is accused of committing criminal work “of misusing official position or authority”.
Meanwhile, according to the second device of the indictment, he is accused of misusing his official duty by marking false data in the official document, so that after receiving the IX class journal, in biology class he had swam 11 students of this class with marks on his will, without the knowledge of the teacher, now witness Hysen Halilaj.
