Executive order to block property and suspend entry to the United States of designated persons contributing to the destabilising situation in the Western Balkans
V TAKING PESSIDENCAL
By the authority vested in me as President of Constitution and Laws of the United States, including the International Act of International Economic Powers (50). Next USSC 1701) (IEEPA), National Emergency Act (50) Next USC 1601 .) (NEA), Article 212 (f) of the 1952 Migration and Community Act (8 USSC 1182, and Article 301 of title 3, Code of the United States,
I, JOSEPH R. BIDEN JR., president of the United States of America, through this expanded the national emergency field declared at the Executive Order 13219 of June 26, 2001 (Containing the Property of Persons Threatening International Stabilisation Efforts in the Western Balkans), changed with Executive Order 13304 of May 28, 2003 (The completion of Yugoslavia's Emergency Emergencys and the Editing of the Executive Order 13219 on June 26th 2001), finding that the situation in the territory of the former Federal Socialist Republic of Yugoslavia and the Republic of Albania (Western Balkans) over the past two decades, including the minim of agreements and post-war institutions following the breakup of the former Socialist Federal Republic, as well as widespread corruption within different governments and institutions in the Western Balkans, hinders progress towards effective and democratic governance and full integration into transatlantic institutions, and thus poses an unusual threat to the national security and foreign policy of the United States.
So I command by this:
Section 1. (a) All property and property interests in the United States that come further within the United States are either under the possession or control of any member of the United States of the following persons are blocked and cannot be transferred, paid, exported, retired or traded differently: Every person appointed by the Secretary of the Treasury, in consultation with the State Secretary:
(i) Be responsible or associate, either directly or indirectly involved in actions or policies that threaten peace, security, stability or territorial integrity of any area or state in the Western Balkans;
(i) Being responsible or collaborator, or directly or indirectly involved in actions or policies that undermine democratic processes or institutions in the Western Balkans;
(ii) Be responsible either to be an accomplice, or to engage directly or indirectly in a violation, or an act that has prevented or threatened the implementation of, any regional security, peace, co-operation or agreement of mutual recognition or responsibility mechanism for the Western Balkans, including the Press Agreement of 2018; 2001 Ohrid Framework Agreement; UN Security Council Resolution 1244; Dayton Accords; or Conclusions of the Council of Peace Implementation Conference held in London in December 1995, including decisions or conclusions of the High Representative, the Peace Implementation Council or its Steering Board; or the International Criminal Tribunal for the former Yugoslavia, or, in relation to the former Yugoslavia, the International Residual Mechanism for Criminal Tribunals;
(iv) Be responsible or associate, or be directly or indirectly involved in serious human rights abuse in the Western Balkans;
(v) to be responsible or accomplices, or directly or indirectly involved in corruption regarding the Western Balkans, including corruption from, on behalf of, or linked to a government in the Western Balkans, or a current or former official government at every level of government in the Western Balkans, such as misuse of public assets, expropriating private assets for personal gain or political purposes, or bribery;
(vi) to have assisted materially, sponsored or offered financial, material or technological support for, either goods or services to either person's support, wealth and property interests are blocked in accordance with this order; or
(vii) whether owned or controlled by, or acted or claimed to act on either name, directly or indirectly, each person's property and interests on property are blocked in accordance with this order.
(b) Prohibitions in this article (a) apply only to the extent foretold by the statutes, or to regulations, orders, directives, or licenses that can be issued in accordance with this command, and regardless of any related contract or license granted prior to the date of this command.
Section 2. Article 1 bans on this order include:
(a) Giving any contribution or provision of funds, goods or services by, for, or for the benefit of every person, his property and interests on property are blocked in accordance with this order; and
(b) Taking any contribution or provision of funds, goods, or services from any such person.
Sec. 3. By this definition, the making of donations to types of items specified in Article 203 (b) of IEPA (50 USSC 1702 (b) (2) by, for the benefit of any person and property interests are blocked in accordance with Article 1 (a) of this command would seriously damage my ability to deal with the national emergency stated in the 13219 Executive Order, amended by Executive Order 13304, and, as expanded by this command, and I by means of such donations as we see in this order.
Sec 4. (a) The unlimited entry of the immigrant and not the immigrant to the United States of the citizens determined to meet one or more criteria in the l (a) section of this order would be harmful to the interests of the United States and the entry of such persons into the United States as immigrants or not immigrants, are suspended on this occasion, unless the Secretary of State or Secretary of National Security, in case, determines that the person's entry would not be in conflict with the interests of the United States, including when the Secretary of State or Homeland Security, as defined, as appropriate, based on a general prosecutor's recommendation that would further bring the objectives of the United States.
(b) The State Secretary will implement this order after applying for visas in line with such procedures that the Secretary of State, in consultation with the Secretary of National Security, can decide.
(c) The National Security Secretary will implement this order after applying for non-citizens' entry in accordance with procedures such as the Secretary of National Security can decide, in consultation with the State Secretary.
(d) Such persons will be treated by this article in the same way as persons covered by the July 2493 Proklamat section of July 2011 (Suspending Foreign Access Subject of the UN Security Council Travel Sanctions and International Economic Power Acts)
Sec. 5. (a) Any transaction that avoids or aims to avoid, causes violations or attempts to violate any of the prohibitions specified in this order.
(b) Any conspiracy formed to violate any definite prohibitions in this order is forbidden.
Six. For the purposes of this command:
(a) The term “economic entity” implies a partnership, association, trust, joint venture, corporation, group, subgroup or other organisation;
(b) The term <x0...
(c) The term “person” means an individual or entity; and
(d) The term “person of the United States” means every citizen of the United States, permanent legal resident, entity organized under the laws of the United States, or any jurisdiction within the United States (including foreign branches), or any person in the United States.
Six. Seven. For those of them, property and their interests on property have been blocked in accordance with this order, which may have a constitutional presence in the United States, I find that because of the ability to transfer funds or other assets immediately, the preliminary announcement of such persons who would be taken in line with this order would make those inefficient measures. Therefore, determine that these measures will be effective in addressing the national emergency stated at Executive Order 13219, changed with Executive Order 13304, and as expanded by this order, there is no need to be prior notification of a list or definition made in accordance with this order.
Sec. 8. The Treasury Secretary, in consultation with the Secretary of State, is authorised to take such action, including the proclamation of regulations and regulations, and to use all competencies given to the president by I EPA, as may be necessary to carry out the objectives of this order. The Treasury Secretary, in line with legislation in force, can remake any of these functions within the Treasury Department. All executive departments and United States agencies will take all necessary measures within their authority to implement this order.
Sec. 9. Nothing in this order will prevent transactions for the official business of the Federal Government by employees, money beneficiaries, or their contractors.
Sec. 10. (a) Nothing in this order will be interpreted as damaging or otherwise influential:
(i) The authority granted by law for an executive department or agency, or its responsibility; either
(ii) The functions of the Director of the Management and Budget Office regarding budget, administrative or legislative proposals.
(b) This order will be implemented in line with legislation in force and depending on the availability of budgetary divisions.
(c) This order is not intended and creates any right or benefit, essential or procedural, enforced by law or equality by any party against the United States, its departments, agencies or entities, its officers, employees, or agents, or any other person.
