The duo had to fight again, but delays caused by the Pandemia Covid-19 prompted Fury to seek an alternative.
On Monday, an American judge ruled in mediation that Wilder has the right to face Fury for the third time before September 15th.
The American team had long argued that their fighter had a contractual right to a third war with Fury.
But after delays caused by the pandemic led to a competition in July month to be postponed, the Wilder team sought to shift the period to 2021.
Fury rejected the 2021 date and said he would move away. This led American Judge Daniel Einstein, who is now backed up in Wilder and set a deadline on September 15th for a third contest.
Until we can reach a co-operation with the people of Deontay Wilder, I can't say that [Frity's battle with Joshua] will definitely happen,” Governor Frank Warren told the BBC Radio Today Programming program.

US Fury producers Top Rank did not want to comment on development when contacted by BBC Sports.
Just 24 hours before Monday's arbitration hearing, Fury confirmed that he had agreed to fight British colleague Joshua belt holder I BF, WBA and WBO for the world's four heavyweight titles in Saudi Arabia on 14 August.
Joshua's promoter Eddie Hearn also said several times that the August period was in place, with conditions agreed on.
The outcome of mediation does not necessarily mean a Fury-Joshua war that will not be possible in August, but new agreements will now have to be made to do so.
This may mean that Wilder is offered money to allow the problem to happen.

Saudi authorities are reportedly providing about 106 million pounds just to organise the Fury-Joshua company.
Sales for viewing and sales of tickets will serve to significantly increase the competition's total income.
If it moves forward, Joshua versus Fury will be the first time in the history of heavy weights where all four world titles are on a line.
