Osmani appoints 8 CEC members, for two others addresses Constitutional Court

The presidency through a communiqué to the media has announced that President Vjosa Osmani appoints 8 members of the CEC. While for two other judges, he has turned to the Constitutional Court for Help.

The announcement reportedly has come to terms with proposals from political subjects, and as envisioned with legislation in force.

On the other hand, it is said that there is a uncertainty of constitutional provisions for two other members, where the president is then addressed to the Constitutional Court.

The oath of the CEC judges will take place in the following days:

President Osmani has appointed eight CEC members

Republic of Kosovo President Vjosa Osmani today, in accordance with constitutional and legal competencies, has appointed eight members of the CEC. These appointments have become consistent with proposals by political subjects, and as provided with legislation in force. For the appointment of two other members, there is a uncertainty of the constitutional provisions, in which the president has been addressed with a request for the interpretation of Article 139, paragraph 4 of the Constitution of the Republic of Kosovo based on Article 84 and Article 113 of the Constitution.

Exactly, the demand for interpretation addresses the vagueities raised on two occasions. First, it requires interpretation, in the spirit of the Constitution, of the notions “group” a “ ” interpreted along with the word “ “ (in Article 139uk4), in the case when we have less than six political subjects represented in the Parliament and who have no right to participate in the division of reserved countries as well, and when one group wins over 50% of the vote in the election. Second, clarifications are required regarding the appointment of representatives from the Bosniak community when we have three political subjects in the Assembly, which represent this community and have equal numbers of MPs represented in the Assembly.

Upon receiving the answer from the Constitutional Court, the president of the Republic of Kosovo will take the necessary steps to appoint the two remaining members of the CEC. The oath of CEC members will be made over the next few days.
