According to him, the practice built by The Hague International Tribunal for the former Yugoslavia to offer security and competition from the state regarding designated citizens who have been subject to war crimes charges, seems to be being taken into practice by the Special Court, taking on the basis of the latest decision.
Miftaraj said that if such a guarantee is not made by President Osmani and Prime Minister Kurti, it could also be made by Albanian President Ilir Meta and Prime Minister Edi Rama.
“If this is not guaranteed by Kosovo, the same could be guaranteed by Albania, by President Meta or Prime Minister Rama respectively, but do not have the same weight and importance as coming from Kosovo”, Miftaraj said.
He claims that prior to providing such competition to the Specialised Chambers, whether the institutions of Kosovo or those of Albania, they should also receive a assurance from the accused and their lawyers that they will respect the measures appointed by the court.
The “Taking on the basis that such competition could be applied to other indictees, institutions in Kosovo as the presidency, but also the Prime Minister's Office before making such a decision to ensure, certainly they would have to receive assurances or assurances from their accused and lawyers that they would respect the court-set measures if they were left to defend themselves in freedom. In such cases the word and promise of the president and prime minister are of weight, and they are taken as well by the special court”, Miftaraj says.
Otherwise, a day earlier, the Court of Appeals in Kosovo's Specialised Chambers published the refusal decisions regarding former president Hashim Thaci's applications, former head of the PDK, Kadri Veselin and former Vetevendosje delegation Rexhep Selimi for provisional or provisional release.
