Leona D. (Evers are changed) You can no longer agree on what happened to him. She's been married to Max D for six years. From Vienna. Three years ago the couple brought the daughter Emma back to life. “Emma goes to the nursery here, speaks perfect German. I know a lot of friends too, and I got a job. I would like to spend the rest of my life in Austria”, the 23-year-old Kosovar said heute.
But not everything is going well. The Administrative Court in Vienna has denied Leonidas permission to stay. The reason seems strange. We live in a flat that belongs to my father-in-law. He's more than willing to give us our home available. The apartment is 73,88 square meters, but it seems to be small, so my husband has a small salary and earns very little”, Leona added.
„Australians expelled from Austria”
As head of construction machines, 25-year-old Max D. receives 1,800 euros in net salary (14 times a year). His father gave them the right to live in that apartment.
“Decision under legal law is meaningless”, says renowned Albanian lawyer in Vienna Mirsad Musliu, who is representative and advocate of this family's rights.
In this case, it would be de facto for Austrians to be expelled from Austria, this could not happen”, he says. The Albanian lawyer goes on to say: “Since the child is an Austrian citizen, the mother cannot be expelled, which means the girl, who is closely related to the mother, would also have to leave Austria”.
According to lawyer Musliu, then Max D. who has a close relationship with his wife, if he wants to continue his life with his wife and daughter, but should move to Kosovo. And this is unacceptable.
On the other hand, the article posted on the Facebook page of the heute.at portal has received numerous comments, conveys albinfo.at. Most commentators declare themselves surprised at this decision. But as they write, residences of 73 square meters and revenues of 1,800 euros net are enough for a three-member family. Although most feel sorry for the occasion, they write that there may be other additional reasons for the Austrian authorities to make that decision.
