KLA leaders' parole pageant: Gashi gives the version when Osman and Kurti can do it

Lawyer Tome Gashi, in an interview for Online Economy, has said the country's government and president Vjosa Osmani will be able to provide guarantees for the provisional release of KLA members who are charged by the Special Court.

But that according to him, the guarantee should require Special Court from Kosovo institutions, adding that the Government and the president have no legal reason not to do so.

The Kurti government and President Vjosa Osmani will certainly do it. But parole guarantees of all KLA members who are accused by the Special Court and are under arrest in custody, respectively, cannot make it unilateral. The competitions whatever they are should ask the Special Court from Kosovo institutions, and the Kurti government and President Osmani have no legal reason not to do so. But unilaterally they cannot offer guarantees without being asked by Special Court”, Gashi added.

He said all KLA members should be protected in freedom because even after the establishment of the indictment, there will be additional investigations that will last up to 5 years.

Therefore, he stressed that it is not right for KLA members to be held in custody for a long period of time without starting judgments.

So far, a formal announcement from the friendly states of Kosovo has not been made. These are only wishes that these Kosovo friendly states offer guarantees, the Special Court, that members of the KLA in a future period of time because for now their bail release has been rejected. I believe that all KLA members should be protected in freedom because even after the establishment of the indictment even after confirming the prosecution's indictment still require additional investigations that would occur over a long period of time and the defence also requires additional investigation, but in this case, the protection of all the accused at The Hague of KLA members has the right to make special investigations because they have not been in possession of documents that the Special Prosecutor had in The Hague. The prosecution's been investigating for five years and it seems not enough and requires additional investigation. Procedures at the Special Court will last very minimum are 5 years. It is not fair to hold on for a long period of time without the beginning of judgments”.

Among other things, Gashi says it would best be for Albania to offer such guarantees, but it would hardly approve that requirement.

Gashi stressed that such guarantees would be best to provide the US, England, Germany and France because they are the most powerful states to ensure rule of law.

However, considering that Albania has been deliberately involved with Dick Marty's report, it would be very difficult to approve Albania's request to protect KLA members” in freedom.

I believe that on the basis of the divided thought that we have had from one of the judges who has brought the last decision with which Mr. Thaqi's attorneys and others refused to defend in freedom, he has given his opinion that it would be good for the third state to think not Kosovo, not the Netherlands to offer guarantees for members of the KLA to release them temporarily. It would be best for Albania to offer such guarantees, but given that Albania has been unfortunately involved with Dick Marty's report, it would be very difficult to approve Albania's request to protect members of the KLA in freedom. I think it would be best for such guarantees to provide the United States, England, Germany and France, but these are the most powerful states to ensure the rule of law because if such guarantees by the Special Court are approved they will in no way allow you to contact possible witnesses and identify with the indictment that are and contact co-accused”.

“Arancions such as these will not ensure the provisional release of KLA members, but it is a great help for the Special Court to take their release more seriously because their long stay in custody is completely unnecessary and not legal. In the case of Mr. Thaqi, Kadri Veselini, Rexhep Selimi and Jakup Krasniqi, the prosecution has declared there are about 250 witnesses and demands another 50 additional witnesses to be questioned again and to be lost a great time”.

During Sunday, it was reported that Croatia and Slovenia have offered immunity to former KLA leaders being held at The Hague.
