The detainees at the Special Court are violating basic human rights.
This is the judgment of Kosovo justice experts, following the Special's refusal to release on condition former Liberation Army commanders and the inability to meet their families.
Over six months have already been held at The Hague, where the Court also has headquarters, and no visit has been granted.

Even the lawyer accredited to Specialised Chambers, Taulant Hodaj, claims that the “Special Court is obliged to implement the European Court of Justice practices regarding the rights of the detainees”.
“From the beginning of the pandemic they (The Court) have suspended these detention rights regulations because of COVID, but now these are not justified, other institutions have adapted to these circumstances”, says Hodaj.
Even for lawyer Ali Rexha, also accredited near Specialised Chambers, this is a serious violation of the Penal Code procedure, “because six not allowed a family member's visit is embarrassing”.
What the Court had to do, as Rex0 explains, is “to find appropriate alternatives that would allow the detainees to enjoy their rights”.
Taking into account that the detainees are far from home, the Special Court was supposed to vaccinate family members, or a remote visit, such as 10 meters away, is definitely supposed to be possible with family members”.
Even for Hodane it's no longer “the pandemic”. “We currently have the ease of measures, and they have to have additional protocols, such as the Covid-19 test or the vaccine to allow visits”.
Lawyer Hodaj further explains with practical example how this issue is regulated by international justice mechanisms, and how important it is to conform to banned rates in detention centres.
The European Court for Human Rights has developed a practice in dealing with the detainees and their rights, it says: Pre-prison rights should not be denied or defined to the extent that the detainees made the resocialism” difficult.
An idea of how the court is forced to change the form of operation in proportion to the detainees has been said by Valon Murati, expert of the Human Rights Convention and former minister and president of the political party Movement for the Union.
“A public pressure in this direction, I believe it is the right tool”, Murati told the Albanian Post.
The first arrests by Special Court took place at the end of September, when former head of Kosovo Security Force and former home chief was sent to The Hague The KLA, Sali Mustafa, on which charges are burdened by “war crimes”, and “participation in joint criminal enterprise”.
Then, on 25 September, leaders of the KLA War Veterans Organisations Hysni Nducati and Nasim Haradinaj were arrested on charges of revealing information that are protected by the Specialised Chambers Law.
On November 5th, other members of the KLA's General Staff, Hashim Thaci, Kadri Veselini, Jakup Krasniqi and Rexhepi were arrested.
For Thaci and Veselin the prosecution claims they are “responsible for about 100 murders”.
Over the detainees are charges of “crimes against humanity and war crimes, including murder, forced extinction, persecution and torture”. /Albanianpost. com
