Pointing to the specifics of applicants as victims, that 11 of them speak Serbian and 5 of them Albanian, the Office for the Members of Victims has considered even cases that could hinder their representation together in a group in Kosovo or Serbia.
The ZPV letter also says that 9 applicants as victims live in Serbia, three are from diaspora and live in different parts of the world, while 5 live in Kosovo, one of which speaks Serbian.
The ZPV has also announced that it has contacted each applicant separately, stressing that the goal was to see if there is any irreconcilable difference among applicants that would ensure a recommendation of more than one group.
One of those submitted as victims, the ZPV says it has declined to join others to be represented as a group.
“Application arguments are partly related to ethnic affiliation and the particular circumstances of his case, as well as a possible conflict of interest with other victims”, the letter says.
Others are said not to object.
“However, after carefully analyzing the individual circumstances of the applicant and the group's overall features, The ZPV considers that the arguments of the applicant do not constitute a situation that would guarantee particular representation”, the letter said.
It also mentions legal representation of those represented as victims. The ZPV says it will support its proposal to appoint the lawyer of the victims to the secretary based on a set of criteria.
The last ones to be arrested and sent to The Hague are the four former political and military leaders of the KLA, former President Hashim Thaci, former leaders Kadri Veselin and Jakup Krasniqi, as well as the head of the Vetevendosje Movement Parliamentary Group (LVV), Rexhep Selimi.
On November 4th, former spokeswoman KLA, Jakup Krasniqi was arrested and sent to special custody. To the same destination, on a military plane, former war associates Hashim Thaci, Kadri Veselini and Rexhep Selimi left the following day.
The arrests came after a Special Court preliminary procedure judge had confirmed the charges against four former KLA leaders. They are accused of war crimes and crimes against humanity. The incident holds Thaci, Veselin, Krasniqi and Selimi responsible for a series of crimes allegedly committed at several detention centres during 1998-1999. The specialized prosecutor, among other things, accuses them of having been or should have been aware of such crimes.
