Trial postponed against ex-cop accused of shooting at his ex-wife

The absence of prosecutor Yavorka Princevic was due to postpone the retrial hearing in the case of the accused of serious attempted murder, Artim Gashi. Neither was the defendant Gashi, whom Judge Foniqi said the court has sent no orders for conduct.
However, when the same contacted the Transport Unit, namely, official Bujar Zeqiri, the latter announced that they were able to bring the court's indictee in 30 minutes.
However, in the absence of the prosecutor, the judge did not issue an order of conduct.
Presented in the courtroom were defenders of the accused, lawyer Mentor Neziri, court translator Blerta Bekteshi, father of the injured B.C., and experts at the Institute of Forenzic Psychiatry, Dr. Brad Obertinca, Dr. Valbona Blakay-Ramadani and clinical psychologist Arife Veseli.
In the absence of legal conditions for holding the session, the same was postponed for May 11, 2021, at 13:10.
By contrast, the Constitutional Court in Pristina, in September 2018, had sentenced former police officer Artim Gashi to 15 years in prison for the criminal act <x0); the serious murder in attempted”.
However, unhappy with the height of the sentence has remained the prosecution, who against this act had filed a complaint in Appeals, demanding that a higher prison sentence be pronounced against the accused.
In this case, the Court of Appeals, on December 17, 2020, has annulled the Constitutional Court's conviction in Pristina and the case has turned into retrial, with the suggestion that a super expertise be established, where at least one of the experts is a university professor of the respective issue. According to Appeal, once the expertise is taken, the same should be assessed and decided by law.
According to the indictment, completed on March 23rd 2021, Artim Gashi is being charged that on February 4th 2017, around 09:30, on the “Job Ahmeti” street in Pristina, after a preliminary preparation had forwarded him from the damaged B house. C, who was off for college exam, had stopped him and tried to force him into the car.
However, according to the indictment, after being injured, he refused, in order to deprive him of life, with the official weapon, the type “Glock”, had struck him with a bullet in his head, precisely in his left eye, the blow from which the injured had cut off his left eye tissue, while the bullet had penetrated his brain, decapitated his brain, with cases of injury causing serious body injuries for life with permanent health consequences. It said the defendant had left the scene.
With this, the prosecution charges Gashi with criminal activity “severe attempted murder” by Article 173 paragraph 1, points 1.3 and 1.8. About KPRK Article 28.
