At the pretrial hearing on the performance of the Peter Shala case, his defense has asked the Special Prosecutor's Office not to edit the names of the victims, especially those who have died.
Commander “Wick” during this session was not present in the hall, but that session conveyed through the Zoo.
Peter Shala's lawyer, Jean-Louis Gillissen said so far It has been a unilateral procedure but has now sought to be in confrontational procedure on both sides.
A big problem in my opinion is getting materials back to the indictment under the 102 rule, because we've got the proposal from the prosecution and we ask that evidence supporting the indictment be made available to us as soon as possible in 30 days after the prosecution's preliminary appearance. So far it has been a unilateral procedure and we understand it, but now we want to have a confrontational procedure, that is, the participation of both. We want to receive protocold statements and transcripts of procedures conducted in the past to have full information on the procedure we want to get materials regarding the act without editing except for those dealing with witnesses. But we think that the names of the victims especially those who claim to have died is very important to Mr. Shala know. Therefore, and we want that with the exception of witness-related editing we want to have an unconditional, confrontational procedure between the two sides”, he said.
Peter Shala's lawyer, Jean-Louis Gillissen He said the defence still does not have a timetable determined when to conduct its own investigations.
The defense confirms that it is intended to conduct its own investigation, but at the time, we cannot give a date as long as we anticipate our investigative activities. The defence is not able to disclose whether or not I will give the alibi announcement or other reasons for the exception of criminal responsibility, but we will certainly stay in touch with the tribunal and the prosecution to provide information when we learn more about it. We also confirm that we intend to make specific classifications on this issue... we want to propose some other additional subcategioris in the context of criminal elements and second at other locations. The defence is ready to examine any proposed model for the consolidation table for the extraction of” materials, he said.
While, the specialised prosecutor stated that four witnesses were presented in supporting the indictment, but predicted to present another eight.
We have very few investigative steps left in this process we do not anticipate that these steps delay the process further. We will actually present four witnesses with material supporting the indictment and predict to present the maximum eight additional witnesses. This is also part of the information we gave you yesterday in writing. We've presented a deletion of what material essentially contains these are witness statements involving other reports, orders and other materials. We expect that other materials that will be presented after extracting the indictment's supporting material will be similar to these”, the prosecution said.
The Special Prosecutor's Office has announced that they are planning to take out matter until July 30th, 2021.
“The ZPS plans to close its task under the 102nd rule regarding the extraction of materials by July 30th 2021, however, 30 days before the prosecution issue begins depending on the translations we are waiting for. The number of witnesses should not be more than 8 and we expect that additional documents do not believe to be more than 54, including the indictment's supporting material regarding translations, but we continue to review documents. We expect the material in the witness's statements to be translated until the appointed time. Regarding the final point, if we predict editing and protective measures, we believe that some of the materials related to witnesses and other documents can be accessed into the account that requires protection or editing measures, or can be entered into the category requiring specific measures”, the prosecution said.
The Special Prosecutor's Office said they anticipate the list involving no more than 3,000 documents.
Regarding the translation of Albanian-language materials by SPS, some of the documents have been declared to have been completed, but some translations have not yet been made and expect to take place within the 30-day legal deadline.
The protection of Peter Shala and SPS have indicated that the editorial regime is of reconciliation to follow the regime used in Haradinaj's Gucati case.
Peter Shala was arrested on March 16, 2021 by Belgian authorities and transferred to The Hague on April 15, 2021.
Shala, who is known in war as “Commander Wolfface”, has declared himself innocent of all charges charged.
