The victims, both in the 50s, were found in passenger seats.
Tesla did not immediately answer questions sent by the BBC for comment, Periscopi reports.
Evidence shows that “nobody was driving during the time of the accident,” said Mark Herman, who added that the case was still under investigation.
It's unclear if Tesla's autopilot piece was in use.
What Tesla calls Autopilot is actually a semi-autonom system that can guide the car to go under limited circumstances. A more sophisticated version, called <x0vet-to-retire version”, is expected to be launched this year.
