Murati: Document concept for seizure of illegal property has two risks

Fighting corruption requires empowering the justice system, creating executive mechanisms can be problematic for democracy, but also for fighting corruption itself

Fighting corruption is an important pillar of developing a society. But this war, it must be careful not to turn into a tool of power to pursue political opponents and discipline and fear the occupants. The populist governments the slogan for fighting corruption turn it into one of the means by which they strike the foundations of democracy and power divisions. In this regard, we too need to be careful and considerate as associates. The government at the latest meeting adopted the concept of the document for confiscating illegal property. Today the prime minister through a Facebook statement explained what the principles of a possible law are. What's disturbing about the approach of this document concept is the establishment of an agency that would have the right to state and seize what it considers illegal wealth without a judicial procedure. The prime minister's subtext implied that reforming the judicial system, including the property, takes time, so we should cut short on this process. This has two risks. The first such mechanism can be transformed into a political disciplinary waste that this government (but another in the future) can only use against its critical and dangerous critics to violate human freedoms and human rights, both civil and political, but socio-economic, and on the other hand, creating an additional state mechanism can only increase opportunities for more corruption and complications in market economy functioning. Our businesses, but citizens also need no more state mechanisms that will interfere with their lives, but for more law enforcement and especially the functioning of the judiciary.

I have full conviction that no matter how long and hard, there is no other way to fight corruption and rule of law except by empowering the justice system. Building intermediate mechanisms only complicates the process. Thus the empowering of the justice system is conveyed to a political culture that fights corruption even to executives (which is the duty of every government) would also create a very irreparable social climate for the functioning of corruption. Politicians and visionary governments also think of the period when they are not in power themselves so they work to create laws and policies that would be stable in the long term.

I am hopeful that in the process of debate over the law, we will have a contextary debate, with quality interference from civil society, legal experts, but also from international partners so that the new law will be a useful mechanism of rule of law and not of the use of law by politics for its own interests.
