The Constitutional Court in Gjakova on Wednesday has sentenced him to a year in prison on condition of the former chairman of the Electoral Commission for a decision in Malisevo, Shefqat Zogaj, accused of falsification of voting results in early elections in 2017.
Under the trial pronounced by judges Drilon Harachia, the prison sentence against the accused will not be executed unless the same commits another criminal act within the verifiable period of two years.
To the same, supplementary sentences have been pronounced, respectively, lifting the right to be elected, as well as stopping the practice of profession, activity or duty, so that they are denied the right to be elected as candidates in the local or central elections of the Republic of Kosovo, as well as preventing the exercise of duty to participate as observers, leaders, commissions or other KEC-organised positions in length of four years.
Otherwise, the indictment has been declared a day after accused Zogaj has pleaded guilty to the criminal act he is charged with at the initial session held on April 20, 2021.
According to the act of Constitutional Prosecutor in Gjakova, founded on 17 March 2021, Shefqet Zogaj is tasked with criminal work “falsification of the vote result” by Article 219, KPRC's 2-1 paragraph, reports the “Bettim for Justice”.
According to the indictment, on June 11, 2017, in the village of Burim of the Malisheva municipality, following the closure of the post-700 polling stations, misusing its election-related position or authorisations, has incorrectly recorded the election results in election documents.
In accordance with the indictment, he has done so since the critical day, which was authorised by the CEC in early elections for the Republic of Kosovo Assembly, as chairman of the Election Commission at the deployment at the “18 school. April”, just after the vote count in the Candidate Resolution Forum, contrary to the Law for General Elections in the Republic of Kosovo, has registered incorrectly within a political subject the votes of several candidates and has scored several other candidates, registering 86 votes, out of them 66 added votes and 20 votes removed, with a total of 86 votes hurting various candidates within political subjects for the general elections.
