Bajrami: Politicians remember the Constitution only when they want to take power

One of its main designers, Constitutional Law Professor Arsim Bajrami, says the Constitutional Day should also be marked to thank martyrs and martyrs who have contributed to the liberation and independence of Kosovo. Bajrami says writing the Constitution is a historic act.
“A third of the Constitution has emerged from the Ahtisaari Plan, and we have fought the main battle with Ahtisaari experts for the content of the Constitution and compromises that have been done mainly on minority rights, the double majority of issues of vital interest, certain rights granted to minorities, especially to the Serb community, which is unfortunately misusing them, is not using them for the real reason what we have given them, but misusing them by blocking the state of Kosovo, preventing political decision in the Kosovo Parliament and Government, and enabling the Serb influence on Kosovo's military, Bajrami says.
In this regard, Bajrami says a unity should be achieved between the opposition and opposition for laws requiring two-thirds in the Parliament and international agreements, citing co-operation with non-Serb minority communities as necessary.
In this way, according to him, the Serbian List's influence would be fully relatable, and the same could not prevent the state of Kosovo, as has happened in the case of transforming KSF into the Kosovo Army.
Among other things, Bajrami estimates that Kosovo institutions have failed to decently mark the Constitutional Day.
According to him, on April 9th a solemn session in the Kosovo Assembly would have to be held and activities with young people and students are necessary in order to show the importance of the highest judicial act in the state. Constitutional Law professor says politicians in Kosovo are reminded of the Constitution only when they want to take over or retain power.
If you see constitutional violations these 13 years, if you see who has violated the Constitution, the main violators are the state itself, the state institutions, we have two presidents removed because of the violation of the Constitution, we have dozens of canceled laws, we have dozens of acts of governments, canceled prime ministers, we have many acts of canceled municipalities, and even decisions of the Supreme Court, which the Constitutional Court has declared no constitutional. So who's violating the constitution, the state itself and state institutions, citizens here are virtually victims, whenever the state violates the constitution the victims are citizens, they suffer because the leaders themselves do not have the damage, nor do the leaders of parties, so the damage goes to citizens with political crisis, with the lack of economic development, with unemployment of<1>, he says.
The writer of the Kosovo Constitution says skeptics should know that this constitution will function much longer than anticipated.
“The constitution is extremely clear but the political culture is lacking in us, and the ambition of politicians to take power has abused the Constitution. We have not made a constitution of the Chinese or Indian model of five thousand articles, we have made a constitution for good governance, for cultured people, for cultured leaders who do not violate the constitution and do not run to take power by abusing the Constitution because whenever major cases have been filed in the Constitutional Court, even in 2014 of case V. LAN, and then, the Constitutional Court has always confirmed that constitutional norms are clear”, Bajrami adds.
The Kosovo Constitution, adopted on April 9th 2008, is prepared through an accelerated process and drafted by a small number of local experts, under international expert supervision. The latter made sure that its provisions are compatible with the Ahtisaari Pack. / KP
