The Constitutional Court in Gjilan has approved Gjilan's Constitutional Prosecutor's request, assigning the detention measure to 30 days' detention of defendants Mr. P. and B. T.
According to the tribunal, there is suspicion based that defendant Mr. P. Since 2012, by the end of 2020, as an official in the quality of the official for the evaluation and verification of apps, the Directorate of Agriculture in the municipality of Gjilan, ongoing and with the aim of illegal property benefits for itself and the other B.T. defendant has exceeded his competencies, enabling defendants B.T., the illegal benefit of subsidies.
The defendants allegedly committed ongoing criminal acts, from 2012 to 2020, which means the defendants acted in a context and, in effect, there is the danger that if the same were set free, they would continue to commit criminal acts.
With these actions, defendant Mr. P., allegedly committed criminal work “misusing official duty or authority”, while defendant B. T., in the farmer's quality, has committed criminal work “subsidies” actions sanctioned with the Criminal Code of the Republic of Kosovo (KPRK).
The judge of the preliminary procedure at the Ra's Crime Department, after holding the hearing, in order to ensure the normal conditions for the development of the criminal procedure, has set the detention measure, considering that the same if found in freedom would eliminate material evidence.
The sides have the right to appeal to this decision at the Court of Appeals.
