The Specialised Prosecutor has responded to the defence court for reviewing the detention of former KLA commander Salih Mustafa.
The specialised prosecution in their response says detention of Mustaf is necessary.
In fact, personal fears such as job loss or economic damage are necessarily associated with a criminal case of this nature. Such circumstances in themselves do not ease or keep in sequence the dangers of being released. Rather, the return of the accused to his job and workplace would cause a number of circumstances (communations, movements, contacts, and so on) that cannot be effectively monitored and that would only increase the same risks that only the continued detention of the Akkugue can effectively manage”, their response is said.
The specialised prosecutor has said that no conditions would be enough to avoid possible risks - that, according to them, Mustafa's detention is bound so as not to flee or try to prevent investigations.
“SPO reiterates that no conditions would be enough to ease the identified dangers of Article 41 (6) (b). These risks, considered only or together, can be effectively managed only at the Centre of Para-burg. Paradition is the most effective tool to limit the ability of the accused to escape or otherwise prevent the jurisdictional achievement of the KSC, investigations or judicial procedures, and /or commit other crimes. Therefore, release, either unconditionally or unconditionally, should not be given”, says their response.
So, Specialised Procorure has demanded that the judge of the preliminary procedure refuse to present the defense and order the accused to remain in custody.
We remember Mustafa has been part of the National Liberation Movement organisation since 1988.
During the illegal activity, he was arrested by Slobodan Milosevic's regime in 1993 and sentenced to 5 years in prison for organising the armed uprising.
In August 1997, after ending his prison sentence, Mustafa was committed to organising and expanding the KLA in the Pristina region, Obilicqi, Gjilan, Kamenica's Year.
