Requalification of the task of killing the young man in Decan: Family raises criminal charges against the prosecutor

Two days after prosecutor Agron Uka requalified the case of the young man's murder by “grave murder” in the assassination from carelessness”, the victim's family has filed criminal speculation against him.

The Tetaj family lawyer, Berat Tmava, has stated to Gazeta Express that there is enough evidence that prosecutor Uka is due to abuse of his duty or authority.

“I am in preparation for documentation. I've made a criminal complaint against the prosecutor who took those actions. There is sufficient evidence to investigate this prosecutor and file an indictment against him, for criminal work “Use of his duty or authority””, Tmava has declared.

Tmava has indicated that after the decision by chief state prosecutor to change the case, the prosecutor has asked Lumez to appoint Prosecutor Sahid Gashi, who had filed the indictment at the outset.

“Today after realizing that the chief state prosecutor has made a decision to change the prosecutor's case, I have submitted a request to appoint prosecutor Sahid Gashi of the Constitutional Prosecutorship in Pec, who has filed the indictment”, Tmava said.

Tmava indicated that already hearing at the Saban Gogaj handheld, which was prior to holding this Friday, has been postponed, as the case will be investigated from the start.

Otherwise, on Tuesday prosecutor Agron Uka has requalified the work from “heavy murder” to “Murder from carelessness”.

And for that, Agomis' father, Isuf Tetaj, has sent a public letter in which he is accusing prosecutor Agron Uka of manipulating the murder case of young Agonis Tetay.

My son was killed at his place of work on Sunday by the son of the business owner in whom he was employed. I am writing in order to inform and alert you that the prosecutor. Agron Uka, yesterday at the trial hearing in which the final word by the parties was spoken without any evidence, and in all reality has re-qualified my son's murder from serious murder to murder by carelessness”, wrote Isuf Tetaj in his letter.

Tetaj in the letter he sent to State Chief Prosecutor Alexander Lumezi, US Ambassador to Kosovo Philip Costnet, Britain's ambassador to Kosovo Nicholas Abbott and Germany's Joern Rohde, has also attached the Act of Paj's Constitutional Prosecutorship to accused Shaban Gogaj.

Also, Isuf Tetaj in this letter also attached the video from the moment his son was killed at work.

With this letter, he has demanded that prosecutor Agron Uka be expelled from the case, as well as a merit trial regarding his son's murder.

And the Tetaj family demand approved today by Chief State Prosecutor Alexander Lumez. He has stated he has taken the decision to appoint another prosecutor in the case of the young man's murder by Decani.

“As the chief state prosecutor I am concerned and at the same time ready for justice to go to the country. Therefore, to prevent bias and avoid prejudice in the case of Agony Tetaj's murder, I have made a decision today that within my legal competencies take the course from the prosecutor of the case and reassign it to another prosecutor”, it is said in the response of the chief state prosecutor.

Lumez has even warned that after their class assessment, those who have engaged in nonprofessional events will respond to their actions.

Also, after the assessment of the course, all those who have engaged in nonprofessional events and contrary to the law will respond to their actions. It is therefore important for all and the general public to understand that the State Prosecutor makes no exception, no matter where he works or who he co-operates with, Lumez stated.
