President resolved after full publication of bias for replacing MPs

Late last week, the Constitutional Court has approved the complaint of two deputies of the Vetevendosje Movement over the replacement made in the past legislature, which has ruled that after securing the gender quota of 30 per cent, the replacement of MPs should be made on the basis of votes taken and not on the basis of gender.

However, in the current legislature, the replacement of MPs has likewise been made.

In order to eliminate the possibility that MPs' mandates will be contested, political circumstances connoisseurs say that the publication of the Constitutional Court's full judgment on the matter should be expected.

Emir Abrashi from Democracy Plus tells Kosovo Press that it is very important to expect the release of the Constitutional Court's full justice so that there will not be a situation when MPs' mandates are rejected as is the case of former President Etem Arifi.

The bottom line is to expect the release of the Constitutional Court's full decision and then the Central Election Commission to see if any of the candidates who have already been replaced but have not taken the oath, failed to meet the criteria for being an MP in accordance with the Constitutional Court's decision. So at this stage, I think it's not good to go with the oath of the new deputies without this job being clarified by the CEC, at the end of the country's institutions, in this case the Kosovo Assembly could continue with the election of the president so that we don't have a situation when MPs' mandates would be controversial and come to the point that we came up with Mr. Arifi, who also declared the government Hoti as no constitutional. So, at this stage I think it's extremely important that the president's election take place after the full establishment of the Constitutional Court and after replacing the candidates for deputies from the CEC”, he said.

Although awaiting full publication of the Constitutional Court's act could cause delays, political analyst Rasim Alija says it is important not to have the constitutional crisis afterwards.

There may be delays, but what's important is that the country does not enter this cycle of institutional crisis and the political subjects are aware of this, and above all, it is once again aware of the outcome of February 14th, that the basis has been laid on large-scale definition of the vote and opposition parties”, he said.

He does not expect the president's election to have an obstacle on the part of the opposition, as according to him, the opposition would turn out to be a loser unless Vjosa Osmani votes for president of the country.

This is the rest that concerns the outcome of February 14th, which dictates other opposition subjects, has led to an act carried out that is definitely their vote against Vjosa Osman for election as president. Then we would have new early elections and this under current circumstances would be a certain political suicide for other opposition subjects, because their trend I am convinced will be on the decline because it is very short time from the 14 February elections, and this other opposition subjects know the best”, he says.

As for replacing MPs on the part of the CEC, in a written response from this institution say the CEC has made the recommendations of MPs' candidates by relying on Article 112 of the law for general elections, which correctly stipulates that a member of the Assembly is replaced by the legal candidate in line of the same gender.

As for reviewing any replacements made last week, the CEC's response reportedly will do so if asked.

Of course, if required by the CEC to review any recommendation for the next candidate to replace any MP, this will happen. The CEC is awaiting full trial to see all the details and obligations to be implemented”, said CEC deputy Valmir Elezi.
