The MS ruling has reacted to Ehat Miftaraj, executive director of the Kosovo Institute for Justice (IKD).
He has said that any decision taken to turn legitimacy into institutions should be based on law and procedure. According to him, MSH Secretary Naim Bardiqi, in this case has made a big mistake.
According to Miftaw reference to the regulation under which the decision was made is wrong.
The return of legitimacy to institutions is and should remain a guide for every minister, secretary-general within the competencies and responsibilities he has. Any decision should be based on law and procedure, however. In a concrete case, Secretary Bardiqi has made a big miss at the legal base regarding the annulment of this competition. The reference to rule 2001/19 is wrong. This UNMIK regulation is not in force and there is no place under the legal basis of decision”, Miftaraj has said.
Miftaraj in his reaction also questions that the decision was not prepared by Bardiqi himself.
Your authority as Secretary General in the MS does not flow into any circumstances, and no way in that law but in other laws on state administration, and government regulations on the fields of administrative responsibility of the Prime Minister and Ministers who are applicable to Kosovo. Maybe someone made your decision, and that someone shouldn't make mistakes to this kind of”, wrote Miftaraj on Facebook.
