In a long reaction to Facebook, Berisha has mentioned several points on which he is based that the murder has been accidental.
This is his full status:
I reason on the bitterness and grief of the damaged side, but not also the speculation of justice manipulation because they are simply untrue and motivated for personal monetary benefits (I do not interpret in the close family)
1. Recycling the criminal offence from the serious murder in the reckless murder, committed by the prosecutor in the final case in the criminal case against Mr. Saban GOGY, is the right and legitimate act and decision, which dates from a long way of investigation and trial, with active participation of the damaged party and their representative.
2. This long, laboring road, not just for the damaged party, eventually pointed out that now killing the late Agos T ETHA was just a tragic accident, and not a serious murder on purpose, as had been wrongly prescribed by the Founding Prosecutor in Pec, the prosecutor Sahede GASI, respectively.
3. The prosecutor who represented the prosecution's body in the judicial examination, along with the damaged party and its representative, has labored in every way and in any way to find evidence and evidence to prove Mr. Shaban GOGY as a serious murder.
4. Despite their efforts and unlimited opportunities available to the Prosecution, the damaged side, and their representative for about two and a half years, they failed to provide even a single test that proves the existence of Mr. Saban GOGY to deprive the dead man Agomis T of life ETHYA and risking the lives of his colleagues.
5. In the absence of the existence of the motive, will and purpose, any conscientious and responsible prosecutor would have to reconsider Mr. Shaban GOGUY as a careless murder, for just doing so would bring justice to the ground.
6. It is a nonconventional fact that the prosecution's role is not only to protect the interests of the damaged party, but also there is a legal obligation to protect the constitutional rights of the accused party and to make sure that the same commitment is carefully and equally accountable to the guilty and guilty evidence.
7. All those jurists, of course, who claim that in concrete cases there was evidence proving Mr. Saban GOGY to deprive the dead man Agomis T of life ETHAI invites them to first analyse all the evidence provided during the investigation and administered during the trial, to look at the videos from 7am to the critical moment of the tragic day and only then try to draw conclusions about Mr. Saban GOGIA.
8. Persuasion of Mr. Shaban GOGYA from the heavy murder in carelessness was a fair and legitimate act and decision, inviting any field expert and those who think they learn about justice to publicize Mr. Saban GOGIA has been illegally and without legal backing from the Prosecutor.
