Kosovo's Institute for Justice (IKD) has reacted to developments in the criminal case, where charged with the recent murder of the late Agonis Tetaj is Shaban Gogaj, who was initially charged with criminal acts of serious murder, while at the session that was held on March 16th, prosecutor Agron Uka had re-qualified the criminal act in the murder of recklessly.
After all the doubts raised on this case, The IKD welcomes the decision of the chief state prosecutor, who, under his legal competencies, has received the subject in question by prosecutor of the Agron Uka case and will also re-assign it to another prosecutor.
Also, the chief state prosecutor has asked the chief prosecutor of the Constitutional Prosecutorship in Gjilan, Arben Kadriu, as competent authority to take all necessary actions under the law for the disciplinary responsibility of judges and prosecutors to the prosecutor, Agron Uka.
On this occasion, The IKD requires that this decision by the chief state prosecutor be followed even by adequate measures against one of the key acts in this case, which is former Prosecutor's Prosecutor's Prosecutor, Haxhi Drcgi. The IKD requires that criminal and disciplinary procedures be initiated against former Chief Prosecutor of the Appeals, Haxhi Dörgut, due to the illegal manner the former chief prosecutor, decided that the Constitutional Prosecution in Pec be excluded from this subject and that the same be delegated to the Founding Prosecutor in Gjilan. Such an action, Dorg had done by overcoming his legal competencies, since the same have given the Appeals Prosecutor no opportunity to decide on the exception of basic prosecutors”, it says in response.
